records separate from the Lessor's material which he receives a royalty payment on. No <br /> royalty shall be paid for materials brought onto the property. <br /> a. The tonnage shall be determined after the Materials have been loaded into trucks <br /> and weighed, and shall be paid on the basis of scale tickets. Payment shall be made <br /> within seven(7) days after receipt of payment by the Lessee from its customers. (In <br /> the event the Material Is stored on the Premises and not removed from the <br /> Premises, no charge for royalties shall accrue for storing the Material on the <br /> Premises). The scale ticket shall be made for all material mined or materials bought <br /> it;to the premises for whatever purpose. <br /> b. In the event royalties are not paid within ninety(90)days after removal of the <br /> materials, regardless of whether Lessee receives payment from its customer,the <br /> royalty is due and owing on the product,the outstanding royalties due shall incur <br /> Interest at 12%per annum therafter. Upon written notice from the Lessor to the <br /> Lessee,then Lessor may require a cessation of any removal or mining of the <br /> Material, until the same has been brought current, including the removal of any <br /> stock piled gravel on the Premises. <br /> 5. Access to Records and Audit. The Lessee shall grant the Lessor access to the records of <br /> the Lessee to verify, monitor or audit the scale tickets to determine the quantity of <br /> materials removed from the Premises,according to scale tickets,with the date of such <br /> removal, The Lessor and/or its agent shall.have a.rig' <br /> htto audit the Lessee's records <br /> upon forty-eight(48) hours notice. Such audit shall take place at the Lessee's place of <br /> business during ordinary business hours. <br /> 6. No Warranties Granted. The Lessor makes no representations concerning the Lessee's <br /> ability to obtain a gravel, land or mining permit to mine and remove Material from the <br /> said Premises,nor have any warranties been made concerning the quantity,quality or <br /> avallablilty of grayei. <br /> 7. Removal and Improvement Eauioment. All improvements and equipment placed on the <br /> Premises by the Leaee,shall be remove from the Premises upon the expiration of the <br /> Lease,weather permitting. In no event shall the improvements and equipment remain <br /> upon the Premises more than 120 days after the expiration of the Lease or any options <br /> to renew thereon have expired. <br /> 8. Compliance with Laws. Lessee acknowledges that this Lease is subject to certain <br /> requirements for the operation of a gravel pit including, but not limited to, State Mining <br /> Permits,County Land Use Permits, Department of Health and Environmental Protection <br /> 2 <br />
