In the BA, seven (7) conservation measures were proposed to <br />avoid or minimize effects by the Proposed Action to all four endangered Colorado River <br />fish and critical habitat in Reed Wash and the Colorado River and its 100-year floodplain. <br />The conservation measures are listed in Section 4.3.1.4, page 27 of the BA located in Exhibit <br />19 of the PAP. These conservation measures have also been incorporated into the operations <br />plan for the Loadout and are discussed in Section 2.04.11 of the PAP. Conservation <br />measures described in the BA (Items 3 through 7) are applicable to the Loadout and are <br />summarized here: sediment ponds will be lined to prevent seepage of potentially <br />contaminated water; discharge of water from the ponds is prohibited; disposal of water and <br />sediments from sediment ponds will occur off-site at an approved facility; control of fugitive <br />dust will occur; sediment control measures will be implemented; and use of potentially toxic <br />herbicides near critical habitat will be restricted. <br /> <br />16. The Division has contacted the Office of Surface Mining, Reclamation Fees Branch. As of <br />this time, CAM is current in the payment of reclamation fees required by 30 CFR Chapter <br />VII, subchapter R (2.07.6(2)(o)). <br /> <br />Section B - Rule 4 <br /> <br />I. Roads - Rule 4.03 <br /> <br /> A. Haul Roads <br /> <br />Haul Roads # 1 and #2 have been designed in accordance with the requirements of <br />Rule 4.03.1.1. <br /> <br /> B. Access Roads <br /> <br />The Access Road has been designed in accordance with the requirements of Rule <br />4.03.2.1. <br /> <br /> C. Light-Use Roads <br /> <br />Light Use Roads #1 and #2 are in compliance with the requirements of Rule 4.03.3. <br /> <br />II. Support Facilities - Rule 4.04 <br /> <br />The Loadout is a stand-alone facility, permitted by the Division under its own individual <br />permit. The Loadout is not included in the permit of any other coal mining, processing or <br />loading operation. All facilities associated with the Loadout will exist at the Loadout site. <br />The Loadout itself will have no off-site facilities. Construction of the Loadout will not <br />result in damage to, or in destruction or disruption of, oil, gas, or water wells or pipelines, <br />coal slurry pipelines, railroads, or utility lines which pass over, under or through the permit <br />area. Therefore the Division proposes to re-approve the Loadout’s activities (4.04(6)). <br /> <br />III. Hydrologic Balance - Rule 4.05 <br />
