The inspection was <br />conducted by Clayton Wein and Daniel Hernandez of the Division of Reclamation, Mining and Safety (the <br />Division). Tonya Hammond of Snowcap Coal Company (SCC), Jim Stover of J. E. Stover and Associates and <br />John Justus (SCC’s attorney) attended the inspection representing SCC. James Beckwith , attorney for Mr. Rudy <br />Fontanari, David Fox (Fox Engineering Solutions, Inc), Ken Walter (Walter Environmental) and Trevor Gross <br />attended the inspection on behalf of the landowner, Rudy Fontanari (Fontanari party). The weather was cloudy <br />with intermittent snow showers. The temperature was 36 degrees F and the ground conditions were dry turning to <br />damp by the end of the inspection. <br /> <br />This inspection was conducted as a follow up inspection to the November 6, 2018 Informal Conference associated <br />with bond release application SL-11. One of the purposes of the November 6 inspection was to determine which <br />features identified in the August 14 -16, 2018 inspection need maintenance repairs pursuant to C.R.S. 34-33 - <br />131(h). Additionally, there were three new features identified by the Fontanari party after the August 2018 <br />inspection that were brought to the Division’s attention at the Informal Conference held on November 6, 2018. <br />The three new features were included in the November 28 inspection and included in the list of f eatures requiring <br />maitenance repairs . Snowcap Coal Company and the Fontanari Party requested at the November 6 informal <br />conference that the Division conduct a site inspection to identify and mark which features the Division will require <br />SCC to make maintenance repairs pursuant to C.R.S. 34-33 -131(h). During the course of the inspection, the <br />Division identified 25 features that will need to be repaired by SCC. All f eatures listed under the Hazard to the <br />Health and Safety of the Public section of this report correspond to the 25 features identified and marked with T - <br />posts by the Division in the field on November 28, 2018. All persons that attended the inspection visited the 25 <br />features that require maintenance repairs . The locations of the features were recorded using a BADELF GPS unit <br />connected to a Panasonic Toughbook. The features were incorporated on to Figure 1.
