For several reasons (namely, distance from the Loadout disturbances, locations <br />that are upgradient of the proposed disturbances, sediment control at the loadout, and the dilution <br />effect of the Colorado River), it is not anticipated that the approved Loadout disturbances will <br />injure any water rights in the permit area and adjacent areas. <br /> <br />There are three water rights within the permit area. The operator owns two of the water rights <br />while a third water right is listed as being abandoned by the court. <br /> <br />Just west of the permit area are three water rights. Two are comprised of six springs but are on <br />the west side of Loma Drain and are hydraulically separated from the planned loadout <br />disturbances. The third is owned by the operator. <br /> <br />A cluster of five monitoring wells and three industrial wells are located on the east side of the <br />industrial area, north and south of Haul Road #1. Due to their distance from the Loadout, these <br />wells are not anticipated to be affected by the loadout’s operations. Further to the south of this <br />well cluster are five additional water rights associated with pumps, a pond, a canal and one <br />pumping pipeline owned by the operator. <br /> <br />There are eight water rights that are located across the state highway and railroad to the northeast <br />of the permit area. These water right sites are listed as diversion points, a spring, one pump and <br />pipeline and one irrigation ditch. All of these sites are at least 3000 feet upgradient of the planned <br />disturbance, so no negative effects from loadout operations are expected. <br /> <br />Four water rights involving two irrigation wells and a ditch with an associated pump are located <br />at least 6,000 feet downstream of the proposed loadout, alongside the Colorado River. Also, <br />three water rights associated with two ponds and one monitoring well are located about a mile <br />from the east end of the proposed haul road. Because of the distances involved, and the dilution <br />effect of the Colorado River, negative effects are not expected. <br /> <br />Should water rights be injured due to the operations at the Loadout, CAM has a water supply <br />replacement plan in place. Details of the alternate sources of water can be found in Section <br />2.04.7(3) of the permit application. <br />
