PERMIT#: M-2012-004 <br /> INSPECTOR'S INITIALS: ECS <br /> INSPECTION DATE: December 3,2018 <br /> OBSERVATIONS <br /> This inspection was conducted by Eric Scott of DRMS as a routine monitoring inspection of the 12.55 acre 112c <br /> North Star Pit. This inspection was conducted because DRMS was near this site conducting another <br /> inspection for a Weld County permit, and it was determined that due to the remote location of this site, it <br /> would be most efficient to inspect the North Star site at the same time. Upon arriving at this site, Mr. Scott <br /> identified himself to on-site personnel Brett Bruham and Mike Carmody, and explained to them that this was a <br /> routine DRMS monitoring inspection. No other permittee representatives were present during the inspection. <br /> The pit is located in an area that is still being actively farmed, and the site identification sign was present near <br /> the access point to the site at county road 138. The previous inspection for the North Star site was conducted <br /> in April of 2018. At that time it was noted that care would need to be taken to remain within the permit <br /> boundary and not impact off-site areas. <br /> During this inspection it was observed that mining activity had increased considerably since the last inspection <br /> in early 2018, and that a processing plant and additional stockpiles were now present on the floor of the <br /> approved pit area (see attached photos). Although active mining was not occurring during this inspection, <br /> several large semi-trailers arrived and were loaded from existing material stockpiles during the time DRMS <br /> was on-site. <br /> It was also noted that the affected area now extends well beyond the permitted area on the east and west <br /> sides of the permit. DRMS collected GPS data during this inspection to delineate the extent of the affected <br /> area (see attached map). The additional unpermitted affected area consists of approximately 7.5 acres that <br /> have been stripped, or are in the process of being stripped, of topsoil along the east and west sides of the <br /> approved permit area. <br /> As noted on the first page of this report, affecting in excess of two acres outside of the approved permit <br /> boundary is considered to be mining without a permit for enforcement purposes. This matter will be <br /> scheduled for an enforcement hearing before the Mined Land Reclamation Board as specified in the Reason to <br /> Believe a Violation Exists letter sent to the operator. <br /> Page 2 of 4 <br />
