Box 483 <br />Paonia, CO 81428 <br />December 6, 2018 <br />Re: Bowie No. 1 Mine, Permit No. C1981038, TR64 Adequacy concerns No. 2 <br />Dear Mr. Bear: <br />The Division has reviewed Bowie Resources, LLC (BRL) responses to the Division's <br />preliminary adequacy letter, dated November 1, 2018. BRL's responses were received on <br />December 5, 2018. Stipulation No. 59; was previously attached to the permit and required that, <br />"Bowie Resources, LLC (BRL) shall submit an application for a Technical Revision addressing <br />the design for reconstruction of the affected segment of East Roatcap Creek, in accordance with <br />Rule 4.05.4. The revision must be approved and issued by the Division prior to commencement <br />of any reclamation activities related to Ponds W-1 and W-2 at the West Mine." TR64 was <br />submitted to address Stipulation No. 59 requirements. <br />The following adequacy comments for TR -64 are based on the Division's review of adequacy <br />responses received on December 5, 2018. <br />The Division understands that Bowie Resources has reconsidered the East Roatcap Creek <br />channel reconstruction and is no longer planning to armor the channel with riprap. <br />However, we still require that reconstructed channels be designed, per Rule 4.05.4, which <br />applies to both channel diversions and stream channel reconstruction. (We regret that this <br />was not clearer in our preliminary adequacy review, but we were addressing the plan for <br />a riprapped channel.) Please provide SEDCAD modeling results and a design drawing. <br />Alternatively, Bowie Resources may provide another type of analysis to show that the <br />reconstructed channel will likely remain stable during large runoff events. For example, <br />calculations could be done with a simpler model or models than SEDCAD. The Division <br />is available to discuss the details of a proposed alternative analysis. <br />2.
