EXHIBIT H <br /> WILDLIFE STATEMENT. <br /> The Colorado Springs office of the Colorado Department of <br /> Parks and Wildlife (CDPW) was contacted around July 26, 2018 <br /> about supplying a Wildlife Statement for this permit application <br /> and declined to comment at this time on the grounds that they do <br /> not provide the service as described in Rule 6 . 8 .4 (1) . <br /> Review of the Conservation Status Handbook for E1 Paso <br /> County indicate that the propose permit area does not lie in one <br /> of the listed Critical Habitat areas of E1 Paso County and we <br /> find no list of endangered or threatened species for the area <br /> around or on the permit area. No raptor nests were observed on <br /> the mine during site inspections and in discussion with the <br /> landowner they do not remember any being present in the past . <br /> The site is mostly grassland and developed agricultural <br /> areas with some ephemeral creek bed running down the central part <br /> of the site. The only trees of any significance are located on <br /> or around the farm yards on the parcel . There are a few shrubs <br /> and scattered small trees on the southern end of the area. <br /> Wildlife resources on the affected lands are limited by the <br /> existing ground cover consisting of seasonal grasses, shrubs and <br /> weeds . Ground cover in this area averages 25% or less, with some <br /> areas having little or no cover, only exposed sand. <br /> Not a lot of wildlife have been observed on the area. <br /> Usually it consisted of larger mammals such as deer and antelope <br /> that use travel corridors over the area. Some small game species <br /> and birds have been observed. Wildlife expected to be found on <br /> the property may include deer, antelope, small rodents and <br /> mammals, and song birds . There are no known threatened or <br /> endangered species on the property. <br /> Existing wildlife in the area is not expected to be <br /> significantly impacted by mining at this site. Temporary and <br /> permanent losses of food and habitat is not expected to be <br /> significant as the area of disturbance will be limited to less <br /> then 10% of the permit area at any given time . Haul road speed <br /> limits will be limited to 15 MPH or less . <br /> Prior to opening an area for mining, Ellicott Sand & Gravel <br /> will make observations of the new area to determine if there are <br /> raptors using the site as active hunting areas, over night roost <br /> sites or nesting sites . If any are observed, the Colorado <br /> Springs Office of the Colorado Parks and Wildlife (CPW) office <br /> will be contacted to confirm the observations and advise Ellicott <br /> Sand & Gravel on what actions should be taken to avoid disrupting <br /> the sites during nesting times . Ellicott Sand & Gravel, will <br /> then take the appropriate actions to prevent disturbance to the <br /> nest or roost site . If raptor use occurs or is observed after <br /> mining activities have commenced on an area then CPW will be <br /> contacted to advise actions that can be worked out to operate the <br /> mine without completely abandoning the site for long periods of <br /> time . <br /> 23 <br />
