Conditions of Approval I hereby approve the proposed SWSP in accordance with §37-90-137(11), C.R.S. subject to the following conditions: 1. This SWSP is approved for the period of November 1, 2015 through October 31, 2018. The approval of this SWSP supersedes the previous SWSP dated February 5, 2015. A renewal request for this SWSP must be submitted to this office and the Division 2 office (please copy Kathy Trask at Kathy.Trask state.co.us) with the statutory fee (currently$257) no later than sixty days after receipt of this SWSP approval letter. 2. Well permit no. 67860-F(WDID 1105182)was obtained for the current use and exposed pond surface area of the gravel pit in accordance with 537-90-137(2) and (11), C.R.S. Permit condition#8 required a cross-sectional drawing of the extent of the intended excavation after the initial excavation. In order to maintain a valid well permit for the exposed groundwater, the required drawing needs to be provided. 3. The total surface area of the groundwater exposed at the Jesse Lee pit must not exceed 0.40 acre during the approval period of this SWSP resulting in an annual evaporative loss of 1.06 acre-feet. 4. The annual amount of water used at the operation shall not exceed 1.0 acre-foot for dust control and the total product mined shall not exceed 9,000 tons per year resulting in 0.26 acre-feet of water lost with the product. 5. All pumping for dust suppression must be metered in compliance with the "Amended Rules Governing the Measurement of Tributary Ground Water Diversions Located in the Arkansas River Basin". The meter shall be certified by a state approved Well Tester and the meter readings reported to the Water Commissioner and Division 2 office. Failure to comply with this condition may result in additional SWSPs not being approved in the future. 6. Accounting of water in this plan, including pumping, stream depletions, and replacement water deliveries must be provided to the Water Commissioner (JJA0.5UtJQn@state.co.U5)and Division Engineer (AUgmenlAtion.coordinatorostate.co.us)with the subject line"Pelino-Jesse Lee Pit SWSP"on forms and at times acceptable to them. Said accounting must be received by the 10t'of the month following the month being reported. The name, mailing address, and phone number of the contact person who is responsible for operation and accounting of this plan must be provided on the accounting forms. Failure to provide monthly accounting and reporting may result in an order from the Division Engineer and could result in fines and penalties of up to$500 per day. 7. The Applicant is responsible for coordinating the monthly release of required replacement water with the Upper Arkansas Water Conservancy District.
