The application was deemed complete on October
30, 2018. TR-86 is proposing to re-construct a stock pond on the Goforth property. A letter from the
landowner approving the location and design of the stock pond was included with the application. The
Division finished its review of the TR-86 application and has the following adequacy questions or
comments.

1. Comments were received on November 7, 2018 from RoseAnne Guire (GW46) who owns the
land below the proposed location of the stock pond. In her comments, Mrs. Guire is concerned
that the proposed stock pond does not comply with the “Livestock Water Tank Act of Colorado,”
C.R.S 35-49-101 to 35-49-111. Please clarify if the proposed stock pond falls under the
jurisdiction of the above statute and if so, provide proof that the requirements of the statute have
been met.

If you have any questions or need additional information, please contact me at (303) 866-3567 ext. 8142.

Sincerely,

Brock Bowles
Environmental Protection Specialist
brock.bowles@state.co.us
