and all were in good repair. Ponds were not impounding or discharging water at the time of inspection (a
very small pool of water was accumulated in Pond 1). A small animal burrow in the upper portion of the
northwestern embankment of Pond 2 was in need of repair. Mr. Ferris radioed for crew to address this
during our inspection.
Straw wattles on the north side of the Pond 2 North Ditch were recently replaced and are in good
condition.
Sediment was beginning to accumulate in the coal gate culvert on the east side of the permit boundary.
Mr. Ferris radioed for crew to clean the culvert during our inspection.
Topsoil (Rule 4.06):
Elk Ridge Mining and Reclamation is in the process of moving the Progresso topsoil stockpile to
accommodate a center pivot irrigation system which has been installed within the reclaimed area.
Although double handling topsoil is not ideal, this will expedite full reclamation and achievement of the
approved post mining land use in the irrigated area.
Conclusions:
Visual evaluation indicates that nominated wells are properly sealed and abandoned, and the surrounding
area was seeded. These activities meet all permitted reclamation obligations associated with sealing and
abandoning the monitoring wells. No corrective measures were necessary. No enforcement actions were
taken as a result of this inspection, nor are any pending.
Page 12
