and all were in good repair. Ponds were not impounding or discharging water at the time of inspection (a <br />very small pool of water was accumulated in Pond 1). A small animal burrow in the upper portion of the <br />northwestern embankment of Pond 2 was in need of repair. Mr. Ferris radioed for crew to address this <br />during our inspection. <br />Straw wattles on the north side of the Pond 2 North Ditch were recently replaced and are in good <br />condition. <br />Sediment was beginning to accumulate in the coal gate culvert on the east side of the permit boundary. <br />Mr. Ferris radioed for crew to clean the culvert during our inspection. <br />Topsoil (Rule 4.06): <br />Elk Ridge Mining and Reclamation is in the process of moving the Progresso topsoil stockpile to <br />accommodate a center pivot irrigation system which has been installed within the reclaimed area. <br />Although double handling topsoil is not ideal, this will expedite full reclamation and achievement of the <br />approved post mining land use in the irrigated area. <br />Conclusions: <br />Visual evaluation indicates that nominated wells are properly sealed and abandoned, and the surrounding <br />area was seeded. These activities meet all permitted reclamation obligations associated with sealing and <br />abandoning the monitoring wells. No corrective measures were necessary. No enforcement actions were <br />taken as a result of this inspection, nor are any pending. <br />Page 12 <br />
