V <br />RECEIVED <br />November 8, 2019 NOV 0 7 2018 <br />Division of Reclamation, <br />Mr. Brock Bowles Mining & Safety <br />Colorado Division of Reclamation Mining and Safety <br />Department of Natural Resources <br />1313 Sherman Street, Room 215 <br />Denver, CO 80203 Sent via email to: brock.bowles@state.co.us <br />RE: New Horizon Mine (Permit No. C-1981-008), Technical Revision No. 86 (TR -86) <br />Dear Brock; <br />On October 17, 2018, Tri-State Generation and Transmission Association, submitted an Application on <br />behalf of Elk Ridge Mining and Reclamation, LLC's New Horizon Mine to construct a Stock Pond (SP1) on <br />the Goforth property. <br />Today is November 8, 2018, which is within the 10 -day comment period of the Publication Date <br />(11/08/2018), per regulations. <br />GW46 Irrevocable Trust owns land adjacent to, and down stream of the proposed SPI and has concerns <br />with the design, construction and impoundment of SP1. We spoke with Jason Ward, Dam Safety <br />Engineer with Colorado Division of Water Recourses, Division 4. As of the date of this objection, the <br />New Horizon Mine has not complied with the "Livestock Water Tank Act of Colorado", C.R.S. 35-49-101 <br />to 35-49-111. <br />If we do not receive a result satisfactory to us, we will elect to move forward with a formal hearing. <br />Thank you for your consideration. <br />Sincerely, <br />RoseA ne M.
