2.03.8 PERMIT TERM INFORMATION <br /> The Eagle No. 5 Mine began operations in 1969. The Eagle No. 6 Mine started operation in 1987. These mines <br /> operated for a period of approximately 26 years, until the mine went into temporary cessation in 1995. During the <br /> period 2006-2010, the Mine was placed on active status due to several ongoing reclamation projects. In 2013, MCM <br /> requested and the CDRMS approved (07/13) a return to the temporary cessation status. The anticipated life-of-mine <br /> for remaining coal reserves, if the mine were to resume operations,is estimated at 15-25 years. <br /> The Eagle No. 5 Mine portals have been sealed and reclaimed. The Eagle No. 6 Mine portals have been temporarily <br /> sealed pending any future decision to resume operations. The Eagle No. 9 Mine is mined-out and the portals have <br /> been sealed and reclaimed. The No. 9 Mine portal area has been utilized as a refuse disposal area, as addressed in a <br /> prior application, and the permitted refuse area was reclaimed in 2008. Total surface disturbance to date is <br /> approximately 442 acres, of which approximately 20 acres have been reclaimed and bond released, with <br /> approximately 288 additional acres which have been reclaimed and seeded. Any anticipated fixture operations would <br /> utilize the existing facilities and disturbance areas,therefore,no additional surface disturbance is anticipated. <br /> The term of this pen-nit application is for 5 years from the date of approval. It is anticipated that permit renewal <br /> applications will be filed in the fixture at five-year intervals, consistent with the right of successive renewal, in order to <br /> maintain the permit, in anticipation of potential future operations. For the horizontal and vertical extent of the <br /> underground mine workings, refer to the No. 5 Mine Plan Map (Map 23), for the Eagle No. 5 Mine, and the No. 6 <br /> Mine Plan Map(Map 24),for the Eagle No. 6 Mine. <br /> 2.03.9 PERSONAL INJURY AND PROPERTY DAMAGE INSURANCE <br /> MCM is self-insured through its parent companies for an amount not less than $1,000,000 for bodily injury and <br /> property damage, and for the same minimum for property damage. A copy of the Certificate of Insurance is provided <br /> in Exhibit 1, Insurance Information. <br /> 2.03.10 OTHER LICENSES AND PERMITS <br /> The following is a list of permits necessary for the MCM underground mining activities. Copies of all historical <br /> permits are included in Exhibit 2, Other Required Permits. <br /> AIR EMISSIONS PERMITS <br /> Issued by: Colorado Department of Public Health and Environment <br /> Air Pollution Control Division <br /> 4300 Cherry Creek Drive South <br /> Denver,CO 80222-1530 <br /> The previous air emission permits were generally tied to individual emission sources or processes. The site has been <br /> inactive since 1995 and process activities are not occurring. Also, ongoing site demolition and reclamation activities <br /> have resulted in removal of most of the permitted emission sources. Given these considerations, MCM reviewed the <br /> status of current and future site activities with the APCD re: appropriate air permit coverage. The APCD <br /> recommended that MCM cancel the existing air permits, since they are no longer relevant, and replace them with a <br /> Land Development GP03 General Permit to cover the ongoing site demolition and reclamation activities. MCM <br /> proceeded with the recommended approach, and now has a General Land Development Emissions Permit approval <br /> (Package 375235) in-place. Supporting documentation has been added to Exhibit2, Other Required Permits, for the <br /> permit(s)cancellation and replacement. <br /> RN18-07 2.03-19 Revised 07/10/18 <br />
