<br /> Subject: Request for additional time, Amzak Pit, M2003-003 Succession of Operators Milling&Safety
<br /> Dear Mr. West:
<br /> Since our last request and approval of an extension (to Monday, 05 November 2018),
<br /> the following has happened:
<br /> 1. We requested agreements from Atmos Energy, Atom Petroleum, and Terra Exploration
<br /> and Product, all possible owners of the fenced pad (and associated equipment) on the
<br /> western edge of the permitted area, on CR-136:
<br /> a. The USPS was unable to deliver the request to Terra, which is, as suspected,
<br /> completely out of business.
<br /> b. The request was delivered by USPS to Atom, but signature was refused to be
<br /> given, and there has been no response.
<br /> c. The request was delivered by USPS to Atmos, and we were contacted by their
<br /> local (La Plata County) supervisor, who reported that the firm's attorneys were
<br /> looking at it and would not contact me. They have not done so.
<br /> 2. In addition (as discussed earlier), Atmos Energy offered to sell their rights to the real
<br /> estate and equipment to Mr. Robert P. Johnson, who originally granted the easement.
<br /> However, Mr. Johnson transferred the property to Durango PTR Properties, LLC, for
<br /> which he is agent and I believe, owner. I forwarded the offer documents to Mr. Johnson
<br /> through Dawn Richardson, with the recommendation that Mr. Johnson deal directly with
<br /> Atmos. We have heard nothing since then.
<br /> 3. As we have discussed, and I understand the situation, we have not yet been able to
<br /> resolve this first (updated documentation regarding significant manmade structures) of
<br /> the two items necessary to complete the Succession of Operator of the Amzek Pit from
<br /> Consolidated Constructors to Richardson Construction Kemble Excavation JV(RCKE):
<br /> 4. Mrs. Richardson also requested updated third-party financial warranty documents, from
<br /> Consolidated Constructors. Mrs. Richardson has not yet been given those. This is the
<br /> second of the two items necessary.
<br /> 5. I have prepared an engineering assessment, as we discussed, and it is my professional
<br /> opinion that none of the mining activities have any impact on the structural stability or
<br /> condition of the equipment and site (including access roads and fencing) which is
<br /> presently (apparently) in the possession of Atmos Energy.
<br /> But we have again hit the deadline for completing these actions, and while progress has
<br /> been made, we need an additional extension. This letter requests another extension to that
<br /> deadline, to Wednesday, 05 December 2018 (30 days), and asking for the Division to allow
<br /> submission of the engineering evaluation which I have prepared, having met the requirements
<br /> for requesting such from all known possible owners and having received no response.
