LD liC01 <br /> October 30,2018 <br /> RECEIVED <br /> Corey DeAngelis <br /> Water Division 1 NOV 0 5 ?G <br /> 810 9th Street, Suite 2005 <br /> Greeley,CO 80631 Divisron of Reclamation, <br /> Mining& uretj <br /> Mr. DeAngelis, <br /> In response to your letter August 30 concerning DRMS Permit No. M-2011-001; Well <br /> Permit No. 76674-F- Martin Marietta Materials(MMM)has recklessly diverted the <br /> Poudre River across our land. Inlet and outlet spillways are so poorly designed, so <br /> undersized,so poorly constructed that they cannot withstand even low spring runoff <br /> flows without damage. Structures built on the river in recent times are deemed 100 year <br /> structures,these spillways did not last one year before being completely destroyed in <br /> 2015.MMM wants to pull up stakes and skip town leaving a poorly engineered site that <br /> is dangerous to the local community. That is cause. MMM should not be allowed to let <br /> the original SWSP expire as reclamation is no where near completion. <br /> Bringing the spillways to original mining permit and UDFCD specifications will change <br /> the existing surface area of the lake making a court decree out of reach.The original <br /> SWSP should be reinstated until MMM has corrected all damages real and potential. <br /> These damages and loss are well documented to the DRMS. <br /> A basic timetable of spillway failures: <br /> 2015- 1 st attempt at reclamation winter of 2015 inlet and outlet spillways constructed. <br /> Both spillways destroyed in annual spring runoff. <br /> 2016-2nd attempt at reclamation. MMM had NOT informed DRMS that spillways had <br /> been destroyed in their annual report so I did it for them. Spillways were rebuilt,top soils <br /> were scavenged for fill as large amounts of soils were taken by the river. This left <br /> remaining soils contaminated with rock and debris. <br /> 2017-3`d attempt at reclamation,both spillways require reconditioning, DRMS is Not <br /> informed. <br /> 2018- October, MMM engineers on site to determine this years repair work on <br /> spillways.DRMS was Not informed. <br /> Regards, <br /> Tim Iverson <br /> cc: John Allis,TZA Water Engineers, Peter Hays,DRMS <br />
