COLORADO
Division of Reclamation,
Mining and Safety
Department of Natural Resources
1313 Sherman Street, Room 215
Denver, CO 80203
Basil. Bear
Bowie Resources, LLC
P.O. Box 483
Paonia, CO 81428
November 1, 2018
Re: Preliminary Adequacy Concern, Bowie No. 1 Mine, Permit No. C1981038, TR64
Dear Mr. Bear:
The Division has reviewed Bowie Resources, LLC application material for technical revision
No. 64. This revision proposes to remove a 650 foot culvert, remove two sediment ponds at the
West mine, and re-establish East Roatcap Creek drainage. Stipulation No. 59; was previously
attached to the permit and required that, "Bowie Resources, LLC (BRL) shall submit an
application for a Technical Revision addressing the design for reconstruction of the affected
segment of East Roatcap Creek, in accordance with Rule 4.05.4. The revision must be approved
and issued by the Division prior to commencement of any reclamation activities related to Ponds
W-1 and W-2 at the West Mine." This technical revision is submitted to address Stipulation No.
59 requirements.
The Division has identified two concerns with the submitted application that need clarification or
correction:
Per the Department of Army letter in your submittal, 1,000 cubic yards of riprap will be
placed in the reconstructed East Roatcap Creek channel. This indicates that the channel
will be an armored structure rather than a simulation of the pre -mining conditions (as
indicated in Sheet 9 of 10 on the Reclamation map in the PAP, with plantings and some
rocks). Please provide a design of the proposed riprap channel (with modeling results and
design drawing) or provide the following:
a. A discussion of why a design is not needed, citing the applicable DRMS rule, and
b. A quantitative analysis or qualitative discussion to show that the reconstructed
channel will likely remain stable during large runoff events.
2. It is unclear why Map 8A-19, which indicates post -mining conditions, includes structures
that will be removed, per the proposed revisions. These structures include Ponds W-1 and
1313 Sherman Street, Room 215, Denver, CO 80203 P 303.866.3567 F 303.832.8106 http://mining.state.co.us
John W. Hickenlooper, Governor I Robert W.
