Box 483 <br />Paonia, CO 81428 <br />November 1, 2018 <br />Re: Preliminary Adequacy Concern, Bowie No. 1 Mine, Permit No. C1981038, TR64 <br />Dear Mr. Bear: <br />The Division has reviewed Bowie Resources, LLC application material for technical revision <br />No. 64. This revision proposes to remove a 650 foot culvert, remove two sediment ponds at the <br />West mine, and re-establish East Roatcap Creek drainage. Stipulation No. 59; was previously <br />attached to the permit and required that, "Bowie Resources, LLC (BRL) shall submit an <br />application for a Technical Revision addressing the design for reconstruction of the affected <br />segment of East Roatcap Creek, in accordance with Rule 4.05.4. The revision must be approved <br />and issued by the Division prior to commencement of any reclamation activities related to Ponds <br />W-1 and W-2 at the West Mine." This technical revision is submitted to address Stipulation No. <br />59 requirements. <br />The Division has identified two concerns with the submitted application that need clarification or <br />correction: <br />Per the Department of Army letter in your submittal, 1,000 cubic yards of riprap will be <br />placed in the reconstructed East Roatcap Creek channel. This indicates that the channel <br />will be an armored structure rather than a simulation of the pre -mining conditions (as <br />indicated in Sheet 9 of 10 on the Reclamation map in the PAP, with plantings and some <br />rocks). Please provide a design of the proposed riprap channel (with modeling results and <br />design drawing) or provide the following: <br />a. A discussion of why a design is not needed, citing the applicable DRMS rule, and <br />b. A quantitative analysis or qualitative discussion to show that the reconstructed <br />channel will likely remain stable during large runoff events. <br />2. It is unclear why Map 8A-19, which indicates post -mining conditions, includes structures <br />that will be removed, per the proposed revisions.
