(Tri-State), is the parent <br />company to Axial Basin Coal Company, which is the general partner to Colowyo Coal Company <br />L.P. (Colowyo). Tri-State received the proposed decision and Findings Document for SL -14 on <br />October X, 2018. After reviewing the findings document Tri-State on behalf of Colowyo is <br />providing the Division with the following corrections. <br />The last sentence of the first paragraph on Page 4 of the Findings Document the Division <br />refers to the East Taylor Pond in the lower elevations of the East Pit reclamation. The East <br />Taylor Pond manages runoff from the West Pit. It is assumed the Division should be referring to <br />the Streeter Pond and not the East Taylor Pond. <br />As stated on Page 4 second paragraph of the Findings Document, "Currently the only <br />ongoing operation in the East Pit is reclamation of the final cut, including backfilling and <br />grading of the pit and highwall reduction. " The last reclamation block for the East Pit was <br />backfilled, graded, and topsoiled in 2016. It is requested that the Division make this correction <br />in the Findings Document. <br />On Page 5 of the Findings Document, the Division notes, "Projected life of the South <br />Taylor Pit is estimated to be until 2017 as per the currently approved Map 23A... As approved <br />under permit renewal 07, Map 23A indicates mining in the South Taylor Pit will occur through <br />2021. It is requested that the Division correct this significant error in the mine plan timing for <br />the South Taylor Pit. <br />On Page 12 of the Findings Document, the Division notes under the "2016 Productivity", <br />"The 2016 sample data for the Section 16 Pit successfully exceeds 90% of the herbaceous <br />productivity standard. " The Section 16 Pit has been fully Phase III released and is not part of <br />the SL -14 bond release application.
