(iii) The operator owns or has access to all the lands upon <br />which surface disturbance exists concerning the train <br />loadout and stockpile area. Delta County has <br />Regulations for Specific Developments. The <br />regulations set forth a public review process and <br />performance standards for the administration of <br />specific development activities within the <br />unincorporated area of Delta County; providing for the <br />requirements and issuance of a Development <br />Agreement for specific developments; and setting forth <br />the penalties for the violation thereof. <br />The Black Bridge Road was realigned during the time the loadout facility was <br />constructed. This realignment significantly improved the use and safety of the road. <br />This road will not be returned to its premining configuration.
