4. On April 5, 2018, the Division mailed the Operator a Reason to Believe <br />a Violation Exists letter for failure to comply with the conditions of the March 2017 <br />Order, specifically, Operator had not submitted the amendment application as <br />required. The Division also informed Operator that the matter had been scheduled <br />for a hearing at the Board's May 16-17, 2018 meeting. <br />5. Operator submitted an amendment application on May 15, 2018 and a <br />fee for the amendment application on May 22, 2018. <br />6. On June 7, 2018, the Division informed Operator that the April 5, 2018 <br />Reason to Believe a Violation Exists letter had been withdrawn but that the <br />amendment application was incomplete and Operator had not yet complied with the <br />March 2017 Order's corrective action. <br />7. On July 23, 2018, Operator submitted a completeness response to the <br />Division. <br />8. The Division responded to Operator's completeness response on July <br />30, 2018 informing Operator that the amendment application was still incomplete. <br />9. On August 16, 2018, the Division sent operator a second Reason to <br />Believe a Violation Exists letter due to Operator's failure to comply with the <br />conditions of the March 2017 Order by not filing a complete amendment application. <br />The Division also informed Operator that the matter was set for a hearing before <br />the Board at its September 26, 2018 meeting. <br />10. The Operator submitted a completeness response to the Division on <br />September 19, 2018, and the Division deemed the application complete on <br />September 24, 2018. <br />11. At the hearing, the Division presented testimony regarding the status <br />of the amendment application. In particular, the amendment application is now <br />complete but is going through an adequacy review process. The Division presented <br />testimony that it is likely that the Division will need additional materials from <br />Operator before the amendment application can be considered final. <br />12. Operator presented testimony through its consultant regarding its <br />efforts to submit a complete amendment application in compliance with the March <br />2017 Order.
