Ralston Reservoir was impassable due to a landslide that had recently occurred on <br />the adjacent Ralston Quarry site. Division staff then provided information <br />regarding the possible unreported slide with off-site impacts to the Division's <br />Minerals program supervisor, Michael Cunningham. Eric Scott, of the Division, <br />called Operator regarding the landslide. <br />4. Operator began stabilization and remedial activities on the slide area <br />on June 13, 2018. This included moving materials from the slide off of the road. <br />5. On June 21, 2018, the Division conducted an inspection of the site. <br />Mark Martin, site health and safety officer and Stan Opperman, vice-president of <br />operations for Operator, were present during the inspection. The Division observed <br />that the landslide consisted of unconsolidated soils and overburden that had been <br />pushed over the top of the ridge from the eastern, mined side of the ridge to the <br />west side of the ridge. The Division noted that, according to historical photos on <br />Google Earth, slope stability had been an issue on the area on a recurring basis. <br />The Division also noted that the area of the slide will need to be evaluated to assess <br />long term stability and determine if corrective measures would be necessary to <br />ensure that additional slides do not occur. The Division informed Mr. Onnerman <br />that Operator was required to submit follow up reporting to the Division on <br />Operator's response -remediation activities <br />6. The Division conducted a follow up inspection on July 19, 2018, after <br />Operator had completed its initial remedial activities. The Division observed that <br />the access road had been cleared of debris from the landslide and was in good <br />condition. The Division also determined that a portion of the area Operator used as <br />a haul route and to stockpile the slide material was located out of the permit <br />boundary but on land owned by Operator. The Division estimated that the off-site <br />impact was approximately 5.25 acres. <br />7. On July 20, 2018, the Division sent Operator a Reason to Believe a <br />Violation Exists letter. The letter provided notice regarding the alleged violations <br />and informed Operator that the matter was scheduled for a hearing before the <br />Board at the August, 2018 Board meeting. The hearing was subsequently moved to <br />the September 26, 2018 Board meeting. <br />8. At the hearing, the Division presented testimony regarding the <br />landslide and the sequence of its contact with Operator regarding the landslide. <br />The Operator did not contact the Division within twenty-four hours of the slide. <br />Subsequent to the slide, the Division and Operator have been in contact, with the <br />Operator providing follow up reporting on remedial efforts. The Division had also <br />been in contact with Operator's consultants, who were hired to advise Operator <br />regarding the slide, measures to address slope instability, and the submission of an <br />amendment. <br />Asphalt Paving Company, <br />Ralston Quarry/M-1974-056 <br />W-2018-035 <br />
