BEFORE THE MINED LAND RECLAMATION BOARD <br />STATE OF COLORADO <br />Violation No. PV -2018-005 <br />FINDINGS OF FACT, CONCLUSIONS OF LAW, AND ORDER <br />IN THE MATTER OF A POSSIBLE VIOLATION BY PRECISION DRILLING & <br />BLASTING, INC., CEASE AND DESIST ORDER, CORRECTIVE ACTIONS, AND <br />CIVIL PENALTIES FOR PROSPCTING WIHTOUT A NOTICE OF INTENT TO <br />CONDUCT PROSPECTING OPERATIONS, FILE NO. M-2018-015 <br />THIS MATTER came before the Mined Land Reclamation Board ("Board") <br />on September 26, 2018 in Denver, Colorado for a hearing to consider the possible <br />violation by Precision Drilling & Blasting, Inc. ("Prospector"), cease and desist <br />order, corrective actions and civil penalties for prospecting without a Notice of <br />Intent to Conduct Prospecting Operations, file number P-2018-015. Mark Mayer <br />appeared on behalf of Prospector. Elliott Russell appeared on behalf of the <br />Division of Reclamation, Mining and Safety ("Division"). <br />The Board, having considered the parties' presentations and having been <br />otherwise fully informed of the facts in the matter, hereby enters the following: <br />FINDINGS OF FACT <br />1. On July 24, 2018, the Division received an anonymous complaint <br />regarding an unpermitted operation on Pennsylvania Mountain in Park County. <br />2. On July 27, 2018, the Division inspected a property located <br />approximately 8 miles west-northwest of Fairplay, Colorado, specifically, Section <br />17, Township 9 South, Range 78 West, 6th Principal Meridian, Park County, <br />Colorado. The site is known as the Pensaukee Lode. The entrance to the site is at <br />39016'3.16"N 106° 7'56.87"W at an elevation of 12,520 feet. No one was present <br />during the inspection. <br />3. During the inspection, the Division observed a large grizzly screen <br />and rock drill on the site, a large surface disturbance near the grizzly screen, and <br />a newly constructed road to the site. The large surface disturbance was <br />approximately 5,788 square feet, and the road was 1,133 feet long with a <br />disturbance of .98 acres. The total disturbance at the site was approximately <br />1.12 acres. <br />4. As the Division left the inspection, they met Mr. Mayer as he was <br />traveling up the road to the site. At that time, Mr. Mayer informed the Division <br />
