The issuance of this permit <br /> does not assure the applicant that no injury will occur to another vested water right or preclude another owner of a vested <br /> water right from seeking relief in a civil court action. <br /> 2) The construction of this well shall be in compliance with the Water Well Construction Rules 2 CCR 402-2, unless approval <br /> of a variance has been granted by the State Board of Examiners of Water Well Construction and Pump Installation <br /> Contractors in accordance with Rule 18. <br /> 3) Approved pursuant to CRS 37-90-137(2)for the change/expansion of use of an existing well permitted under permit no. <br /> 4231-F(decreed by the Division 2 Water Court as Lamar Farms Well No.5, in case no.W-1822,and pending case no. <br /> 12CW37 for inclusion in LAWMA's plan for augmentation decreed in case no.02CW181)on the condition that this well is <br /> operated in accordance with the GP Resources, LLC Substitute Water Supply Plan("SWSP"; ID 5389)approved by the State <br /> Engineer on January 26,2016. This well shall not be pumped under this permit unless it is included in a SWSP approved <br /> by the State Engineer or a plan for augmentation approved by the water court. The subject SWSP approval period is August <br /> 10,2015 through August 9, 2016, and if a new SWSP is not approved by the State Enginer, or a court approved plan for <br /> augmentation is not in operation,diversion of ground water from this well under this permit must cease immediately, <br /> 4) Approved on the condition that this well is operated in accordance with the Amended Rules and Regulations Governing <br /> the Diversion and Use of Tributary Ground Water in the Arkansas River Basin, Colorado. <br /> 5) The use of ground water from this well under this permit is limited to commercial and industrial uses, including dust <br /> control and supplying water for drilling operations for oil and gas wells,and as a water supply for the wash plant for the GP <br /> Aggregates West Farm Pit SWSP(WDID 6707828&SWSP ID 5121). <br /> 6) The pumping rate of this well shall not exceed 1,600 GPM,as decreed in case no.W-1822, Lamar Farms Well No.5. <br /> 7) The combined annual amount of ground water to be appropriated by this well under this permit and seven other existing <br /> wells under permit nos.79628-F and 79630-F through 79635-F shall not exceed 8.1 acre-feet. <br /> 8) The owner shall mark the well in a conspicuous place with well permit number(s), name of the aquifer,and court case <br /> number(s)as appropriate. The owner shall take necessary means and precautions to preserve these markings. <br /> 9) A metering method must be established for this well pursuant to the Amended Rules Governing the Measurement of <br /> Tributary Ground Water Diversions Located in the Arkansas River Basin, and as required by the approved SWSP and case <br /> no. 12CW37. <br /> 10) This well shall be more than 600 feet from any existing well,completed in the same aquifer,that is not owned by the <br /> applicant, and not more than 200 feet from the location specified on this permit. <br /> APPROVED <br /> JWB 2 <br /> Stale Engineer By WA <br /> Receipt No.3668741 B DATE ISSUED 02-03- 16 EXAF44TION DATE I <br />
