As such, no <br /> suitable Owl habitat is known to exist within the Study Area. No Owls were observed <br /> during the site visit. Any change in land use in the Study Area should not adversely affect <br /> the continued existence or available habitat of this species. <br /> Summary <br /> ERC has conducted this screening for threatened, endangered and species of concern for the <br /> Study Area. The screening is intended as a rapid assessment to determine the potential existence <br /> and/or presences of habitat for TES. The following provides key items identified as part of this <br /> screening. <br /> • Migratory birds exist but are unlikely to nest in the Study Area due to ongoing agricultural <br /> activities. Such birds are protected under the MBTA, and killing or possession of these birds <br /> (or their parts and nests) is prohibited under the MBTA. Future land use changes which <br /> require removal or disturbance of active nests will require clearance from the USFWS. <br /> • No threatened or endangered species populations protected under the Endangered Species Act <br /> were identified directly in the Study Area. <br /> • Upon review of species identified as State endangered or threatened, protected by the <br /> Colorado Division of Wildlife (CDOW) under Colorado Statute Title 33, no species were <br /> identified as potentially inhabiting or nesting within the Study Area. <br /> This Report has been prepared by: <br /> Ecological Resource Consultants,Inc. <br /> S�u2�Lw <br /> Kristin A.
