EXHIBIT H <br /> Wildlife Information <br /> The project area was surveyed for general wildlife habitat by Ecological Resource Consultants <br /> (ERC). A wildlife memo from ERC is attached which describes the wildlife habitat present on the <br /> site and the common species that may be found in the habitat area. <br /> ERC also screened the project area for threatened, endangered, and species of concern. They <br /> found that migratory birds, which are protected under the Migratory Bird Treaty Act, exist in the <br /> area but are unlikely to nest in the project area due to the ongoing agricultural activities. <br /> Prowers Aggregate Operators, LLC. will have the project area surveyed for active nesting sites <br /> if any disturbance of the project area is expected to occur during the primary eastern Colorado <br /> nesting season (April 1 to August 15), per US Fish and Wildlife Service (USFWS) <br /> recommendations. <br /> No threatened or endangered species populations protected under the Endangered Species Act <br /> were identified directly in the project area. <br /> No State endangered or threatened species, protected by the Colorado Division of Wildlife <br /> (CDOW) under Colorado Statute Title 33, were identified as potentially inhabiting or nesting <br /> within the Study Area. <br /> Attached is ERC's screening report of threatened, endangered, and species of concern, and a <br /> letter from the USFWS with their comments on the report. <br /> J&T Consulting, rowers Aggregate Operators,LLC. <br /> ■ g+Inc..
