Bowles <br />Environmental Protection Specialist Division of Reclamation, <br />Division of Reclamation, Mining and Safety Mining & Safety <br />1313 Sherman Street, Room 215 <br />Denver, CO 80203 <br />Re: New Horizon Mine (Permit No. C-1981-008 Technical revision No. 85 (TR -85) Permit Boundary Revision & Revised <br />Pond 015 Design (SHPO Project #67409) <br />Dear Brock Bowles <br />Thank you for pour correspondence dated September 27, 2018, received by our office on October 2, 2018 for the above <br />referenced project submitted to our office pursuant to 36 CFR 800,4(d)(1). <br />As the above referenced permit revisions doe not propose additional surface disturbance outside of the currenthv appro\,ed <br />disturbance , it is our opinion that a finding of no historic properties affected is appropriate for the proposed undertaking pursuant <br />to 36 CFR 800.4(d)(1). <br />The consultation process does involve other consulting parties such as local governments and Tnbes, which as stipulated in 36 <br />CFR 800.3 are required to be notified of the undertaking. Additional information provided by the local government, Tribes or <br />other consulting parties may cause our office to re-evaluate our comments and recommendations. <br />If previously" unidentified archaeological resources are discovered in the course of the project, work must be interrupted until the <br />resources are properly evaluated in terms of the National Register of Historic Places eligibility criteria (36 CFR 60.4) in consultation <br />with our office. Should human remains be discovered during mining activities, the requiretnents under State law CA S. 24-80 <br />(part 13) apply and must be followed. <br />Thank you for the opportunity to comment.
