Randall, Executive Director | Virginia Brannon, Director <br />1313 Sherman Street, Room 215 <br />Denver, CO 80203 <br /> <br /> <br /> <br /> <br />Interoffice Memo <br />Elk Creek Mine (Permit No. C-1981-022) <br />2018 Third Quarter Waste Pile Inspection Report Review <br /> <br />Leigh, <br /> <br />I have reviewed the 2018 Third Quarter Waste Pile Inspection Report (Report) for the Elk Creek <br />Mine and have found them in compliance with the following Rules: <br /> <br /> 4.09.1(11)(a) – The coal mine waste bank was inspected by an individual under the <br />direction of a qualified professional engineer during the third quarter. The site was <br />inspected by Doug Smith, of Oxbow Mining, LLC. under Michael Ludlow, PE. The <br />inspections occurred during the third quarter of 2018. <br /> <br /> 4.09.1(11)(b) – The third quarter inspection occurred on September 28, 2018. During the <br />review, there was no documentation on when the report was received by the Division. <br />Due to this, there is no way to determine whether the report was received within two <br />weeks after the inspection as required by the Rules. The required submission date for this <br />Report was October 12, 2018. <br /> <br /> 4.09.1(11)(c) – This rule is not applicable during this phase of waste pile construction. <br /> <br /> 4.10.2(1) – Refer to Rule 4.09.1(11)(a) of this memo. <br /> <br /> 4.10.2(2)(a) – Refer to Rule 4.09.1(11)(b) of this memo. The Division does not require <br />additional inspection frequency for the Elk Creek Mine waste pile. <br /> <br /> 4.10.2(2)(b) – The inspection report took into account signs of erosion and instability <br />along the East Yard and West Valley Fill. Elk Creek also provided moisture density and <br />compaction results associated for only the West Valley Fill #1 and #2 as part of the <br />Report. A total of six areas were tested for compaction using Standard Proctor Testing. <br />Results of the compaction testing ranged from 95.0% to 101.3% for the West Valley Fill. <br />As per Rule 4.10.4(3)(b), compaction requirements during construction or modification <br />of all coal mine waste banks shall be compacted to attain 90% of the maximum dry <br />density to prevent spontaneous combustion and to provide the strength required for <br />October 19, 2018 <br />
