Krieger, Interim Town Manager <br /> Town of Firestone <br /> PO Box 100 <br /> 151 Grant Avenue <br /> Firestone, CO 50520 (sent via email) <br /> RE: Acceptance of Reclamation As Is of a portion of the "Carbon Valley Parcel" <br /> (located in the east side of the Carbon Valley Resource (DRMS Permit M-2001-017) <br /> Dear Mr. Krieger: <br /> This letter serves as official notice that the required reclamation as defined in Section 8.4 of the Purchase, Sale <br /> and Exchange Agreement (PSE Agreement) between the Town of Firestone(Firestone)and L.G Everist, Inc. <br /> (L.G Everist) has been completed on 59.286 acres of the 60.986 total acres of the "Carbon Valley Parcel" of the <br /> Carbon Valley Resource. <br /> L.G, Everist requests that the Town of Firestone accepts and acknowledges the reclamation"as is"of the 59.286 <br /> acres acres of the"Carbon Valley Parcel". The "Carbon Valley Parcel" is described and depicted in Exhibit A-2 of <br /> the PSE Agreement and comprises most of the east side of L.G. Everist's Carbon Valley Resource, which is <br /> permitted under the Division of Reclamation, Mining, and Safety's (DRMS) Permit M-2001-017. <br /> L.G. Everist has completed all the reclamation obligations on 59.286 acres of the "Carbon Valley Parcel" as per <br /> the DRMS Permit and the PSE Agreement, up to and including initial seeding of the vegetated areas. <br /> Reclamation includes the completion of the following: construction, testing and approval of the compacted Gay <br /> wall liner; backfilling; sloping; grading; and the initial seeding of the site. Access roads have been graded and <br /> graveled to allow for future development and reservoir operations by the Towr Firestone. <br /> The only part o` the "Carbon Valley Parcel" that will not be released from the Carbon Valley Resource's DRMS <br /> permitted area at this time is 1.7 acres in the northwest corner of the parcel which contain the office and shop <br /> area. This area is located outside the water storage reservoir of the "Carbon Valley Parcel' and is needed for the <br /> on-going mining operation in the west side of the Carbon Valley Resource, known as either"Brooks Farm" or <br /> "Area C Licensing requirements (between L.G. Everist and the Tcwn of Firestone)for the "fixtures"(buildings <br /> and scale)in this area are described in the PSE Agreement, Paragraph 3.1 (b) (iii). <br /> The reservoir liner in the"Carbon Valley Parcel" has been approved and certified by the Colorado Office of the <br /> State Engineer(SEO) and meets the SEO's strict design standard See attached copy of the SEO's Clay Liner <br /> Approval letter, dated 09/18118. <br /> All areas requiring vegetation in the area to be released have received two rounds of initial seeding to comply with <br /> vegetation requirements. Reclamation seeding and fertilizing was done in April-201Band again in late August- <br /> 2018. LGE has been actively controlling weeds with weed-spraying and mowing over the years In 2018, weeds <br /> were sprayed in May-2018, and the reclaimed areas were mowed in June-2018 and in early August-2018 <br /> L.G. Everist is requesting that the Town of Firestone accept the reclamation of the"Carbon Valley Parcel" "as is" <br /> because the DRMS prefers to have self-regenerating growth on reclaimed vegetated areas in order to release <br /> them from a permit_ However, the DRMS will approve an acreage release request when: all reclamation is <br /> acceptably completed up through initial seeding, and the operator has an agreement with a municipality to <br /> purchase the site upon permit release, and the municipality accepts the reclamation "as is". <br /> M—ownFirestone-ReclamationAsls-rev ised2-0ct2318 docx <br />
