Everist, Incorporated (L.G. Everist or LGE) recently sent you an Acreage Release Request(Sep-2018), <br /> requesting a release of 63.3 acres of the 65.0 acres of east side of the Carbon Valley Resource, DRMS Permit# <br /> M-2001-017. The total acres we are requesting to be released does not change, but we are sending this Acreage <br /> Clarification to explain the different sections that are being released. <br /> We explained in the original Acreage Release Request(Sep-2018)that L.G. Everist and the Town of Firestone <br /> have a Purchase Sale Exchange Agreement(PSE Agreement)for the "Carbon Valley Parcel" of the Carbon <br /> Valley Resource. We also explained that the Town of Firestone would be accepting the"Carbon Valley Parcel" <br /> reclamation "as is". We attached Exhibit A-2 of the PSE Agreement, in the original Acreage Release Request <br /> (Sep-2018) submittal. Exhibit A-2 shows that the "Carbon Valley Parcel," comprises most of the permitted areas <br /> known as AreasA and B in the east side of Carbon Valley Resource. The difference is as follows: <br /> Carbon Valley Resource (M-2001-017) <br /> Area A(10.6 acres total being released) + 10.6 acres <br /> Area B (54.4 acres total - 1.7 acres remaining in permit) + 52.7 acres <br /> Permitted Acreage to be released =63.3 acres <br /> "Carbon Valley Parcel" shown in Exhibit A-2 of the PSE Agreement: <br /> Total acreage of the"Carbon Valley Parcel" + 60.986 acres <br /> Area remaining in DRMS permit(for shop/scale) - 1.7 acres <br /> Acreage to be accepted "as is" = 59.286 acres <br /> The difference between the two totals above is 4.014 acres. This difference is accounted for as follows, with <br /> some history first to explain it: When L.G. Everist permitted the property originally (under the site name of <br /> Lohmann Sand and Gravel), we permitted to the eastern edge of the property and south to the centerline of the <br /> Last Chace Ditch. Years later, the original legal parcel was subdivided into two lots. The original owners, Ted <br /> and Linda Lohmann, kept the area south of the ditch (which was never in the permitted area) and a flagpole <br /> extension for their driveway along the eastern border, extending north to County Road 26. L.G. Everist bought <br /> the other lot, which contains most of the permitted area-and this lot became the "Carbon Valley Parcel". The <br /> "Carbon Valley Parcel" is 4.014 acres smaller than the total permitted acreage of Areas A and B because it does <br /> not contain the acres consisting of the Lohmann's driveway and also the southern border of the"Carbon Valley <br /> Parcel" is the north side of the Last Chance Ditch, rather than the centerline of the ditch like the permitted area. <br /> Please note that L.G.
