Management Plan will be in place prior to site disturbance to ensure storm water is
properly routed around disturbed areas, and/or properly controlled from the site as
storm water runoff. (If required, the Stormwater Management Plan will also comply
with agency requirements.)
(A Stormwater Permit is only required where an operation has the possibility of a
discharge to state waters or from storm water that may come into contact with any
overburden, raw. materials, intermediate products, finished products, by products or
waste products located at the site of such operations.)
0) Description how the Operation will comply with applicable Colorado water
laws and regulations governing injury to existing water rights:
• The operator/applicant will comply with Colorado water quality laws and
regulations governing injury to existing water rights. It is not anticipated
that any water will be encountered. If ground water is encountered, the State
Engineers office/Division of Water Resource Rules and Regulations will be
complied with.
• Any water used for fugitive dust control will be purchased.
• There are no permitted water wells or water well applications applied for
within 600 feet of the proposed borrow operation. (WE were not able to find
any current or new applications for water wells, based on our review of the
Office of the State Engineer records, as of the date of this application.)
(k) If refuse and acid or toxic producing materials ware exposed during
mining, describe how they shall be handled and disposed of in a manner that
will control unsightliness and protect the drainage system form pollution:
No acid or toxic materials will be used or encountered on this site.
(1) Description what measures will be taken to minimize disturbance to the
hydrologic balance, prevent off-site damage, and provide for a stable
configuration of the reclaimed area consistent with the proposed future land
use:
• The hydrologic balance will not be influenced by removal of borrow
material. The initial preparation of the surface before extraction of borrow
material will consist of stripping the topsoil and placing topsoil in a
stockpile for use later during reclamation. Front-end loaders, scrapers,
excavators or other suitable equipment will be used in order to remove
topsoil and borrow material as quickly as possible followed by site
reclamation. The short duration of the borrow operation and timely site
reclamation will minimize impacts to the hydrologic balance.
• SEMA's Corporate Stormwater Management Plan will be implemented to
protect the hydrologic balance.
• Ground water will not be intercepted or otherwise impacted.
• The reclaimed surface will be returned to land suitable for rangeland. The pit
slopes will be 3H:1 V or less. Upon completion of mining, all runoff will
drain to the adjacent ephemeral drainage to the east. In addition, the site has
a high soils infiltration rate and will minimize any significant ponding or
retention of tributary waters. These measures will ensure a stable reclaimed
33
