ARCHAEOLOGY '- Lessee may not excavate, appropriate or disturb any historical, prehistnri[aior <br /> archaeological site or resource un any lands administered byLessor. Discovery Or indication of such a <br /> site or resource shall be immediately brought to the attention of Lessor and the State Archaeologist and <br /> Lessee shall provide evidence that nosignificant archaeological sites exist on the Leased Premises <br /> which could be destroyed bv Lessee's operations. <br /> 36. DEFAULT AND FORFEITURE '' |f Lessee fails to keep each and every one of the covenants and <br /> conditions herein, and if such default continues for a period of 30 days after service Vfwritten notice <br /> thereof upon Lessee, Lessor shall have the right todeclare this Lease forfeited, and to enter onto the <br /> Leased Premises either with or without process of taw, and to expel, remove and putout Lessee orany <br /> person occupying the Leased Premises, using such force os may be necessary tVdnso. <br /> In the event nf the termination of the Lease by reason of breach of any covenant herein <br /> contained, Lessee shalt surrender and peaceably deliver to Lessor the Leased Premises, and such <br /> Leased Premises shall be in good mining condition. If, upon termination of this Lease for any reasun, <br /> whether by surrender, forfeiture orexpiration nf term orotherwise, Lessee shalt not have fully <br /> complied with the terms Ofthe Lease, Lessor shait hold and retain possession of the property' <br /> improvements, and equipment of Lessee as security unto Lessor for the payment of rents and royalties <br /> due Lessor, or to protect Lessor against liens, orLoindemnify Lessor against any loss ordamage <br /> sustained by Lessor by reason of the default DfLessee, for which purpose Lessor is hereby given a lien <br /> upon all such properry, improvements, and equipment, which lien shalt attach as the same are placed <br /> upon the Leased Premises. If Lessor forecloses the ben' Lessor may itself be purchaser at any sale <br /> thereof under such foreclosure.
