G. All areas proposed for disturbance shall be surveyed for a rare variety of <br /> the native wildflower, Meadow Blazing Star (Liatris ligulistylis). If <br /> identified, these areas should be avoided to the greatest extent practical. <br /> H. An outline form of the Reclamation Plan (the complete reclamation plan is <br /> required under Paragraph 19), such Reclamation Plan to include provisions <br /> for grading and contouring Leased Premises subject to previous mining <br /> activity. <br /> I. Provisions and plans to conclude mining and reclamation activities prior to <br /> the termination of the Lease. <br /> 17. 1ENN189MCMAL ANALYSIS: Lessor may require that Lessee submit an <br /> environmental analysis for review by Lessor before any exploration or mining <br /> begins on Leased Premises. <br /> 18. ,AI: Lessee shall submit all plans for restoration and reclamation <br /> of Leased Premises to Lessor for Lessor's approval before submitting the <br /> appropriate permit or permits pursuant to the Colorado Mined Land Reclamation <br /> Act 34-32-101 ET SQ., C.R.S. as amended, and all reports required by Lake <br /> County. Rules and regulations as set forth by Division of Reclamation, Mining <br /> and Safety (DRMS) for recovery and restoration of mined land shall apply where <br /> applicable to the Leased Premises. Elements of the reclamation plan shall include <br /> but not be limited to: <br /> A. Final reclamation must not preclude the future use of the property as a <br /> water storage reservoir, but shall otherwise meet all requirements of the <br /> Colorado Mined Land Reclamation Act and any other applicable laws and <br /> regulations. Lessee shall not rely on any proposed future use to avoid any <br /> reclamation requirements. <br /> B. Contouring map showing approximate contours that will exist upon final <br /> reclamation. Final slopes shall reflect approximate original contours, but <br /> in all cases shall be no steeper than 3h:1v. <br /> C. Backfill operations shall be conducted to maximize compaction to the <br /> extent practicable. <br /> D. All mined areas shall be mapped on a master map and the depth and type <br /> of backfill and the prominent survey points shall be depicted on the map. <br /> The map will also depict geologic and hydrologic conditions encountered <br /> during mining or exploration. backfilled, graded, topsoiled, and revegetated. <br /> Lessee shall obtain Lessor's approval of its proposed reclamation plan prior <br /> to submitting such plan to DRMS. Lessor may require modification of the <br /> reclamation plan. To the extent such modifications result in Lessee incurring <br /> reclamation costs in excess of the costs it would incur to backfill, grade, <br /> topsoil, and revegetate the Leased Premises, Lessor will pay the excess <br /> costs resulting from its reclamation plan modifications. <br /> Page 10 of 20 <br />
