Everist, Incorporated (L.G. Everist or LGE), as Permittee/Operator respectfully submits this Acreage Release <br /> Request for release of 27.98 acres of Firestone Gravel Resource, DRMS Permit# M-1996-052. Please see the <br /> attached Division of Reclamation, Mining and Safety's (DRMS) form, Request for Full or Partial Release of Permit <br /> Area/Surety Reduction. Please see the attached Exhibit F: Reclamation Plan Map (2013) for reference of the <br /> entire Firestone Gravel Resource, and Exhibit A-3 for a map of the area to be released. <br /> Last week, L.G. Everist sent an acreage release request to the DRMS for reclaimed areas in the "Carbon Valley <br /> Parcel" of the Carbon Valley Resource (DRMS Permit M-2001-017). We explained that L.G. Everist has a <br /> Purchase, Sale and Exchange Agreement (PSE Agreement) with the Town of Firestone (Firestone) for the Town <br /> to purchase the "Carbon Valley Parcel". The Town will be developing their own water storage reservoir in the <br /> reclaimed and released area. However, there is more to the PSE Agreement which concerns the Firestone <br /> Gravel Resource and which will be addressed with this acreage release request. <br /> In the PSE Agreement, L.G. Everist and the Town of Firestone also agreed that two "exchange parcels" would be <br /> swapped after the "Carbon Valley Parcel" was released and the the Town of Firestone took over ownership of it. <br /> Both "exchange parcels" are connected to the Firestone Gravel Resource. <br /> Exhibit A-3 - "L.G. Everist Exchange Parcel" (about 27.98 acres) - This "parcel" is a surveyed area that is on <br /> land owned by LGE and being exchanged to Town of Firestone. As you'll see on the Exhibit A-3 map, it is located <br /> along the south and east sides of the Firestone Gravel Resource mine site - and takes small portions out of the <br /> three (3) legal parcels that make up the mine site. The area is generally all the undisturbed acres south of and <br /> including the Side Hill Ditch and 20-50 feet along the eastern boundary of the permitted area, along County Road <br /> 17. The Town of Firestone is planning to use this land in the future as part of their interconnected system of <br /> public trails. The area is undisturbed, and is located on the outskirts of the properties and not land that we were <br /> planning to mine anyway, so there is no reclamation needed. <br /> The other"exchange parcel" is illustrated on Exhibit A-1- "Town of Firestone Exchange Parcel" (about 12.05 <br /> acres) -This land is currently owned by the Town of Firestone and being exchanged to LGE. This piece of <br /> property is not part of this Acreage Release Request. However, when ownership transfers to L.G. Everist, we will <br /> revise the Firestone Gravel Resource DRMS permit (through a TR or amendment) to include the part of this <br /> property (approximately 2.1 acres) that is located south of County Road 26 3/ and is surrounded by permitted <br /> areas in the north-central section of the Firestone Gravel Resource. <br /> FIRE-DRMS-AcreageReleaseRequest-toES-Oct2018.docx Sent via Certified Mail 7016-1370-0001-0670-4140 <br />
