COLORADO
Division of Water Resources
1313 Sherman Street, Room 821
Denver, CO 80203
Response to 112 Construction Materials Reclamation Permit Amendment Application
DATE: October 10, 2018
TO: Eric C. Scott, Environmental Protection Specialist (eric.scott@state.co.us)
CC: Division 1 Office, District 1 Water Commissioner
FROM: Colin Watson, P.E.
RE: Peters 313 Pit, File No. M-2015-045-(AM01)
Applicant/Operator: Weld County Public Works
Contact: Jay McDonald, (970) 304-6496
SY2 of SW'/ of Section 26 and NW'/a of Section 35, Twp 12 North, Rng 63 West, 6th P.M.,
Weld County
CONDITIONS FOR APPROVAL
® Exposure of ground water must not occur during or after mining operations.
® The applicant will need to document that any water used at the site was obtained from a legal source,
or was diverted in priority under a water right decreed for such mining/industrial use.
® If stormwater runoff is intercepted by this operation and is not diverted or captured in priority, it must
be released to the stream system within 72 hours; otherwise the operator will need to make
replacements for evaporation.
COMMENTS: The subject application is for a surface mining operation on 150.5 permitted acres, located
approximately 5 miles west of Hereford, Colorado. The primary commodities to be mined at the site are sand
and gravel, and on site crushing/screening will take place. The site is proposed to be reclaimed to its present
use of rangeland upon completion of the mining operation.
The operation is not expected to directly affect surface or groundwater. Test pitting at the site by others in
the past showed a depth to groundwater of 15 feet. If mining operations exceed 15 feet in depth, excavation
is proposed to stay a minimum of 2 feet above the groundwater level.
Water will be used on site for mining, crushing and dust control, and this usage is not expected to exceed 4,000
gallons a month. The necessary water will be hauled from Weld County's wells that are decreed for dust
control and industrial purposes.
Berms will be constructed around the perimeter of the site to retain onsite surface water runoff. If
stormwater runoff is intercepted by this operation and is not diverted or captured in priority, it must be
released to the stream system within 72 hours; otherwise the operator will need to make replacements for
evaporation. A Colorado Department of Public Health and Environment Stormwater Construction Permit will be
obtained prior to the start of mining operations.
The applicant may contact the State Engineer's Office with any questions.
1313 Sherman Street, Room 821, Denver, CO 80203 P 303.866.3581 www.water.state.co.us
