Everist, Inc. has submitted a request for partial acreage release for 63.3 acres permitted area of <br /> the Carbon Valley Resources Pit, Permit No. M-2001-017. The area to be released contains one lined <br /> reservoir known as Carbon Valley Reservoir (WDID 0504095). The liner of the Carbon Valley Reservoir <br /> was determined to meet the design standards referenced in the August 1999 State Engineer <br /> Guidelines for Lining Criteria for Gravel Pits, and was therefore approved on September 18, 2018. <br /> Also a storage water right was obtained for the Carbon Valley Reservoir in case no. 2005CW335. <br /> The State Engineer's Office ("SEO") has no objection to the request for partial acreage release for <br /> the Carbon Valley Resources Pit, provided all lagged depletions from previous mining continue to be <br /> replaced under a substitute water supply plan approved by the SEO. Water shall not be impounded in <br /> the reservoir except pursuant to lawful diversions allowed by statute or decree. At all other times, <br /> all inflow of water into the reservoir from any source, including precipitation and ground water <br /> inflows, shall be removed by the applicant.
