RULE 4 PERFORMANCE STANDARDS <br />4.16 Postmining Land Use <br />4.16.1 General <br />Implementation of the detailed reclamation plan as presented in Section 2.05.5 will result in a <br />landscape and vegetative cover that is equal to or better than the premining condition for <br />rangeland use that currently exists in the area. <br />4.16.2 Determining Use of Land <br />The premining land uses for the mine plan and adjacent areas are shown on the Land Use Map <br />(Map 17). The narrative describing the land use of the permit area is presented under Section <br />2.04.3. The proposed postmining land use will involve the restoration of the premining land use <br />of rangeland, as described in Section 2.05.5. <br />4.16.3 Prior to Release of Lands from the Permit Area in Accordance with 3.03.1 (2) (c) <br />The land use of rangeland will be restored in a timely manner as outlined in Section 2.05.4. <br />Implementation of the timetables contained therein will assure a contemporaneous reclamation <br />program. No alternative land uses will be implemented in the reclamation plan set forth under <br />Section 2.05.4. <br />4.17 Air Resources Proctection <br />Colowyo employs fugitive dust control measures in all phases of the mining and reclamation <br />activities. The control measures currently used are set forth in detail in Section 2.05.6. <br />The operations at Colowyo are presently regulated under numerous emission permits issued by <br />the Colorado Department of Health, Air Pollution Control Division. Section 2.03.10 identifies <br />the various permits under which Colowyo currently operates. The permits are set forth in Exhibit <br />8, Air Quality Information. <br />4.18 Protection of Fish, Wildlife, and Related Environmental Values <br />As described in Section 2.04.11, no threatened or endangered species have been identified within <br />the active mining operation. Also, no critical habitat for any species is known to exist. Golden <br />Eagle nesting complexes, which are located within the permit area but outside the area to be <br />mined, are described in Section 2.04.11. <br />Electric power lines and other transmission facilities in the permit area will be constructed in <br />accordance with the guidelines set forth in the environmental criteria for Electric Transmission <br />System by the United States Department of Interior (USDI) and the United States Department of <br />Agriculture (USDA) 1970. Distribution power lines are to be constructed by guidelines set forth <br />in the Rural Electrification Administration (i.e., Rural Utilities Service) 1979 Bulletin 61-10 and <br />will suffice for Rural Utilities Service's current construction guidelines for raptor -safe power line <br />structures. Colowyo's design criteria has been developed in association with the Avian Power <br />Rule 4 Performance Standards 4-82 Revision Date: 4/2/18 <br />Revision No.: RN -07 <br />
