RULE 2 PERMITS <br />In regard to the unleased BLM surface and mineral estates included within the permit boundary, <br />no mining or exploration activities will take place on these lands without obtaining the <br />appropriate BLM lease, license, or permits. In June 2004, Colowyo inadvertently extracted 2600 <br />tons of unleased federal coal in SWI/4 of Sec.4, T3N, R93 W, 6t' PM. The area impacted is <br />illustrated on the Mine Plan, Map 23 with the extension of the West Pit Mining Limit boundary. <br />A detailed description of the Permit boundary is contained within Volume 16, Exhibit 1, Item 13. <br />2.03.7 Relationship to Areas Designated Unsuitable For Mining <br />The permit area is not within an area designated unsuitable for surface mining activities as <br />defined in Rule 7 or 30 CFR 764 and 765 or under study for designation in an administrative <br />proceeding under Rule 7 or 30 CFR 764 and 765. <br />2.03.8 Permit Term Information <br />Colowyo has submitted information within this application to cover the entire life -of -mine area, <br />including the next five year permit term. The anticipated timetable for each phase of mining and <br />reclamation and the anticipated number of acres to be affected are shown on Map 23 and Table <br />2.03-1, Affected Areas for Mining and Reclamation. Table 2.03.1 does not include affected <br />acres for the Collom Mine and assoicated facitlies. Please see Volume 15 for information <br />pertaining to the Collom Mine. <br />The acquisition of the Federal Coal Leases D-034365, C-35874, C-29224, C-29225, C-29226, C- <br />0123475, C-0123476, COC -68590 and State of Colorado Coal Lease 257-135 make a <br />substantially mineable coal reserve at Colowyo. <br />2.03.9 Personal Injury and Property Damage Insurance Information <br />The certificate certifying that Colowyo has a public liability insurance policy in force for the <br />surface coal mining and reclamation operation is set forth as Volume 2A, Exhibit 3, Certificate <br />of Insurance. <br />2.03.10 Identification of Other Licenses and Permits <br />The following is a list of permits and licenses covering the Colowyo surface coal <br />mining operation: <br />Colowyo - Facility Wide Air Permit No. 95MF1040, Approved 1/17/2017 <br />Colorado Department of Public Health and Environment <br />Air Pollution Control Division <br />4300 Cherry Creek Drive South <br />Denver, CO 80220-1530 <br />Rule 2 Permits 2.03-23 Revision Date: 4/2/18 <br />Revision No.: RN -07 <br />
