rC*oDNR=
October 3, 2018
COK&l W011:T2\ DI411
Division of Reclamation,
Mining and Safety
Department of Natural Resources
1313 Sherman Street, Room 215
Denver, CO 80203
Williams Fork Mine, C-1981-044
Adequacy Review RN7
Robin,
I have finished my review of the revised pages that were submitted in response to the RN -7 adequacy
review. The following adequacy questions are organized by section. If you have any additional
questions, please let me know.
2.04.12 — Prime Farmland
The Division made a negative determination for the presence of prime farmland in its issuance
findings of September 1983. There is no new evidence indicating that this decision should be changed.
However, the revised page 2.04-46.1 needs to be updated so the reasons given for the negative
determination are consistant and accurate. Please address the following comments:
- The paragraph refering to the amount of annual precipitation as a determinant of prime farmland
is not supported by Rule 2.04.12 -Prime Farmland Investigation. Please remove this paragraph as
it does not support the finding of `negative determination for the presence of prime farmland.'
A USDA, SCS letter dated December 23, 1986 was submitted with the last response from MCM.
The letter states that the Eagle Mine has a growing season of 77 days. This information is
inconsistant with the permit Section 2.04.8 which states the mine area has a growing season of
120 days, and Exhibit K of the permit states the growing season is 94 days. Please update these
sections so the information is consistent.
2.05.6 — Mitigation of Impacts of Mining, Fish and Wildlife
The responses to questions 9 and 10 are adequate.
1313 Sherman Street, Room 215, Denver, CO 80203 P 303.866.3567 F 303.832.8106 http://mining.state.co.us
John W.
