Certified Mail, Return Receipt Requested <br />Request of WildEarth Guardians et al. for Formal Hearing on the Proposed <br />Decision by the Colorado Division of Reclamation, Mining and Safety to Approve <br />Permit Revision No. 15 ("PR -15") for the West Elk Mine (Permit No. C-1980-007) <br />Dear Board Members: <br />On behalf of WildEarth Guardians ("Guardians"), High Country Conservation Advocates <br />("HCCA"), Sierra Club, and the Center for Biological Diversity ("the Center") (together, <br />"Conservation Groups"), in accordance with Section 2.08.4(6)(a)l and 2.07.4(3)(a) of the <br />Regulations of the Colorado Mined Land Reclamation Board for Coal Mining, Conservation <br />Groups request a formal hearing before the Colorado Mined Land Reclamation Board ("the <br />Board") to contest the proposed decision by the Colorado Division of Reclamation, Mining and <br />Safety ("DRMS") to approve Permit Revision No. 15 ("PR -15") for the West Elk Mine (Permit <br />No. C-1980-007) near Gunnison, Colorado. Below we detail the reasons for our request and <br />objections to the proposed decision, in accordance with 2.07.4(3)(a)2. <br />Conservation Groups ask the Board to set aside DRMS's approval of PR -15 for the <br />following reasons: 1) Owner, Mountain Coal Company, LLC ("Mountain Coal") and DRMS <br />prevented Conservation Groups from accessing land crucial to gathering information for the <br />informal conference; 2) DRMS failed to properly scrutinize Mountain Coal's insufficient <br />submission of information in its application during public comment, even after Mountain Coal <br />changed its plans significantly; and 3) DRMS failed to provide for robust public engagement <br />during the permit revision approval process. <br />TIMELY SUBMISSION OF REQUEST <br />Notice of this proposed decision was initially published in the Delta County Independent <br />on September 5, 2018. Section 2.07.4(3)(a) of the implementing regulations provides <br />1 MLRB's hearing and notice requirements for a permit revision, stating that an application for a permit revision <br />shall be subject to the hearing and notice requirements of 2.07.115(1)(b). <br />2 MLRB's standing requirements for a formal hearing by the Board, stating that "any person with an interest which <br />may be adversely affected by the proposed decision" may request a formal hearing before the Board, as long as the <br />request is made within 30 days of the publication of the proposed decision. Such request must be made within 30 <br />days of the first publication of the proposed decision of DBMS. <br />
