Krieger, Interim Town Manager <br />Town of Firestone <br />PO Box 100 <br />151 Grant Avenue <br />Firestone, CO 80520 (sent via Federal Express and email) <br />RE: Carbon Valley Resource - Acceptance of Reclamation As is <br />Dear Mr. Krieger: <br />This letter serves as official notice that the required reclamation as defined in Section 8.4 of the <br />Purchase, Sale and Exchange Agreement (PSE Agreement) between the Town of Firestone <br />(Firestone) and L.G. Everist, Inc. (LGE) has been completed on the "Carbon Valley Parcel" of the <br />Carbon Valley Resource. This letter is also a request from LGE to Firestone that Firestone accepts and <br />acknowledges the reclamation of the acres to be released "as is". <br />The "Carbon Valley Parcel", is described and depicted in Exhibit A-2 of the PSE Agreement (attached <br />for reference) and comprises the east side of the Carbon Valley Resource, permitted under the Division <br />of Reclamation, Mining, and Safety's (DRMS) Permit M-2001-017. To further describe the "Carbon <br />Valley Parcel," it is comprised of the Areas A and B in the east side of Carbon Valley Resource, which <br />is depicted in the modified Exhibit F: Reclamation Plan Map (Revised 7-2018). Exhibit F has been <br />modified to better show the areas which we are requesting to be released. (See the attached modified <br />Exhibit F - Release Request Sep -2018) <br />Details on the Reclamation, Areas to be Released, Areas to Remain in the DRMS permit <br />LGE's reclamation of the "Carbon Valley Parcel" (aka Areas A and B) includes the completion of the <br />following: construction, testing and approval of the compacted clay wall liner; backfilling; sloping; <br />grading and seeding of the site. Access roads have been graded and graveled to allow for future <br />development and reservoir operations by Firestone. <br />The reservoir liner in Area B of the "Carbon Valley Parcel" has been approved and certified by the <br />Colorado Office of the State Engineer (SEO) and meets the SEO's strict design standard. (See <br />attached copy of the SEO's Clay Liner Approval letter, dated 09118198.) <br />LGE has completed all the reclamation obligations on the "Carbon Valley Parcel" of the Carbon Valley <br />Resource as set forth in the Carbon Valley Resource DRMS Permit, including the initial seeding of all <br />areas requiring vegetation. The "Carbon Valley Parcel" has received two rounds of initial seeding to <br />comply with DRMS vegetation requirements. Reclamation seeding and fertilizing was done in April - <br />2018 and again in late August -2018. LGE has been actively controlling weeds with weed -spraying and <br />mowing over the years. In 2018, weeds were sprayed in May -2018, and the reclaimed areas were <br />mowed in June -2018 and in early August -2018. <br />CV-TownFirestone-ReclamationAsls-Sep2018.docx <br />
