RE: Acreage Release Request <br />DRMS Permit: Carbon Valley Resource, M-2001-017 <br />The only part of the "Carbon Valley Parcel' in Area B that we are not requesting to be released from the DRMS <br />permit at this time is the 1.7 acres which contain the office and shop area, and which are located outside the <br />water storage reservoir in the northwest corner of Area B of the "Carbon Valley Parcel'. This area has the <br />scalehouse and shop used in the on-going mining operation in the west side of the Carbon Valley Resource, <br />known as both "Brooks Farm" and Area C of the Carbon Valley Resource. <br />L.G. Everist is requesting this DRMS acreage release prior to self-sustaining vegetation because we have a <br />Purchase, Sale and Exchange Agreement (PSE Agreement) with the Town of Firestone (Firestone) for the <br />"Carbon Valley Parcel". Firestone will take over ownership of the "Carbon Valley Parcel' upon completion of <br />reclamation (all requirements up to initial seeding) of the area and upon release from the DRMS permit. They <br />want to begin development of the water storage reservoir - on the released acres. L.G. Everist has submitted a <br />letter to Firestone requesting that Firestone accept the reclamation "as is" for the 63.3 acres of the "Carbon Valley <br />Parcel' (also described and depicted in Exhibit A-2 of the PSE Agreement). A copy of the letter to Firestone and <br />its attachments, including Exhibit A-2, and the Affidavit of Reclamation Acceptance, is attached for your reference. <br />(LGE will forward the signed Affidavit from the Firestone letter to the DRMS as soon as we receive it.) <br />With all of the reclamation completed in Areas A and B as stated above, LGE hereby requests an acreage release <br />of the 63.3 acres from the DRMS permit. <br />After reviewing this request and attachments, please contact me so we can schedule the acreage release <br />inspection of Carbon Valley Resource.
