Lynch DIVISION OF ML`CLAMATION <br />Environmental Protection SpeciahstMINING AND SAFETY <br />Division of Reclamation, Mining and Safety�� <br />1313 Sherman Street, Room 215 SPF <br />Denver, CO 80203 <br />Re: Foidel Creek Mine (Permit No, C-1982-056) Technical Revision No. 91 (IR -91) W'ash Plant Additional Thickener Tank <br />System (SHPO Project #67400) <br />Dear Ms. Lynch: <br />Thank you for your correspondence dated August 30, 2018, received by our office on September 5, 2018 for the above referenced <br />project submitted to our office is pursuant to pursuant to 36 Cfa 800.4(d)(1). <br />As the above referenced permit revisions doe not propose additional surface disturbance outside of the currently approved <br />disturbance , it is our opinion that a finding of no historic properties affected is appropriate for the proposed undertaking pursuant <br />to 36 C;P'R 800.4(d)(1). <br />The consultation process does involve other consulting parties such as local governments and 'Tribes, which as stipulated to 36 <br />CFR 800.3 are required to be notified of the undertaking. Additional information provided by the local government, "Tribes or <br />other consulting parties may cause our office to re-evaluate our comments and recommendations. <br />If previously unidentified archaeological resources are discovered in the course of the project, work must be interrupted until the <br />resources are properly evaluated in terms of the National Register of Historic Places eligibility criteria (36 CFR 60.4) to consultation <br />with our office. Should human remains be discovered during mining activities, the requirements under State law C.R.S. 24-80 <br />(part 13) apply and must be followed. <br />Thank you for the opportunity to comment.
