List of Notice of Violation Information for all Companies Linked <br />through Ownership and Control to Colowyo <br />Neither the applicant nor a subsidiary or affiliate or persons controlled by or under common <br />control with the applicant has (a) had a Federal or State mining permit suspended or revoked in the <br />last five years; or (b) forfeited a mining bond or similar security deposited in lieu of bond. <br />The Dry Fork Mine (Wyoming DEQ Permit 599-T) has not received any notices of violation in the last <br />three years. <br />The New Horizon Mine (C-1981-008) has not received any notices of violation in the last three years. <br />The New Horizon Mine North (C-2010-089) received the following violation notices during the last three <br />years: <br />Name of Operation — New Horizon Mine North <br />Violation No. — CV -202-006 <br />Date of Issuance of Compliance Advisory letter — October 23, 2012 <br />Violation Issuing Agency — Colorado Division of Reclamation, Mining and Safety <br />Reasons for Issuance — Failure to Protect the Hydrologic Balance in compliance with the <br />Regulations. Failure to pass surface drainage from the disturbed area through a sedimentation <br />pond before leaving the permit. Failure to construct sedimentation pond before any disturbance <br />to be drained into the pond. Failure to submit an engineer certification that the pond has been <br />constructed as designed. <br />Current Status -Abatement Step #1 was satisfied on October 23, 2012, when topsoil salavage <br />operations were brought to a halt. Abatement Step #2 was accomplished on November 30, 2012 <br />when the Dvision was notified that construction of the pond had been completed. Abatement <br />Step #3 was satisfied on December 5, 2012 when the Division determined that the as -built <br />certification will be review as a MR -02 to the permit. WFC was assed and paid a civil penalty of <br />$1,250. <br />Name of Operation — New Horizon Mine North <br />Violation No. — CV -2012-007 <br />Date of Issuance of Compliance Advisory letter — October 23, 2012 <br />Violation Issuing Agency — Colorado Division of Reclamation, Mining and Safety <br />Reasons for Issuance - Failure to protect the physical properties of topsoil from wind erosion. <br />Failure to submit other permits and licenses in compliance with the New Horizon North Permit <br />No. C-2010-089 and with the regulations. <br />Current Status -Abatement Step #1 was satisfied on October 23,2012, when topsoil salvage <br />operations were brought to a halt. Abatement Step #2 was accomplished when the Division <br />issued its proposed decision to approved MR -01 on November 2, 2012.
