List of Notice of Violation Information for all Companies Linked <br />through Ownership and Control to Colowyo <br />Neither the applicant nor a subsidiary or affiliate or persons controlled by or under common <br />control with the applicant has (a) had a Federal or State mining permit suspended or revoked in the <br />last five years; or (b) forfeited a mining bond or similar security deposited in lieu of bond. <br />The Dry Fork Mine (Wyoming DEQ Permit 599-T) has not received any notices of violation in the last <br />three years. <br />The New Horizon Mine (C-1981-008) has not received any notices of violation in the last three years. <br />The New Horizon Mine North (C-2010-089) received the following violation notices during the last three <br />years: <br />Name of Operation — New Horizon Mine North <br />Violation No. — CV -2014-004 <br />Date of Issuance of Compliance Advisory letter — June 27, 2014 <br />Violation Issuing Agency — Colorado Division of Reclamation, Mining and Safety <br />Reasons for Issuance — Significant differences were observed between as -built documentation for <br />NHN-001 East and West Ditches as compared to site observations made during a complete <br />inspection. <br />Current Status — Tri-State has fully cooperated with CDRMS and has submitted a technical <br />revision to the permit to abate the violation.
