Together with a tract of land to be used for drainage
facilities and road fill purposes described as beginning at
the point of intersection of the southerly right-of-way
fence line of County Road #17 with the southeasterly bound-
ary of the above-described transportation corridor, thence
easterly along the southerly right-of-way fence line of
Countv Road #17 for a distance of 90 feet to a point on said
right-of-way fence line, thence northwesterly to a point on
the southeasterly boundary of the above-described transpor-
tation corridor which is 25 feet from the point of beginning
along said southeasterly boundary; thence along said south-
easterly boundary for a distance of 25 feet to the point of
beginning; and
Together with a non-exclusive right-of-way and easement 90
feet in width for an access road adjoining the above-des-
cribed transportation corridor on the southeast side, from
the northerly right-of-way line of County Road #17 for a
distance of 250 feet (measured from the northerly right -of -
way -fence line of County Road #17 northeast along the above-
described transportation corridor; and
Together with a right of entry outside the above-described
transportation corridor onto adjacent lands during the period
of construction for the purposes of (a) constructing and
installing land service facilities in conjunction with and
appropriate to the facilities being constructed in the
above-described transportation corridor, such as relocated
farm roads, right-of-way fences, culverts, approaches for
farm road at -grade crossings, county road detours, irriga-
tion and drainage facilities; (b) constructing channel
changes in Wilson Creek in the permitted locations; (c)
constructing slopes from earthwork operations for the
facilities constructed within the above-described trans-
portation corridor; and (d) wasting excavation materials at
locations specifically authorized by Grantor. All such
facilities constructed outside of the above-described
transportation corridor shall be left in a final condition
which is acceptable to Grantor and Grantor shall have full
use of such facilities and areas after construction has been
completed.
