Western Region Office <br />1999 Broadway, Suite 3320 <br />Denver, CO 80202-3050 <br />September 12, 2018 <br />Jim Stark <br />Coal Program Supervisor <br />Colorado Division of Reclamation, Mining and Safety <br />1313 Sherman Street, Room 215 <br />Denver, CO 80203 <br />Re: Phase I / II / III / Termination of Jurisdiction Bond Release Application SL -3; CAM <br />Mining, LLC; Munger Canyon Mine; C-1981-020 <br />Dear Mr. Stark, <br />This letter acknowledges the Office of Surface Mining Reclamation and Enforcement (OSMRE), <br />Denver Field Branch's (DFB) receipt and review of the Colorado Division of Reclamation, <br />Mining and Safety's (DRMS) August 31, 2018 Proposed Decision and Findings of Compliance <br />pertaining to CAM Mining, LLC's (CAM) Phase I / II / III / Termination of Jurisdiction (TOJ) <br />SL -3 bond release application. OSMRE agrees with the Proposed Decision and hereby provides <br />concurrence in accordance with 30 CFR 740.15 (d)(3) and 30 CFR 906.30, Article IX, Section <br />24 of the State -Federal Cooperative Agreement. <br />DFB participated in the SL -3 bond release field evaluation at the Munger Canyon Mine on May <br />10, 2018. The surface and mineral ownership associated with this bond release is a combination <br />of federal and private. Accordingly, the Bureau of Land Management (BLM) notified DFB of its <br />concurrence with DRMS's Proposed Decision by email dated September 7, 2018. We interpret <br />this to mean that CAM is in compliance with all applicable BLM mineral Iease stipulations. <br />DRMS's Proposed Decision notes CAM's compliance with the approved Colorado regulatory <br />program at Rules 3.03.1(2)(a) — (c) and recommends authorizing Phase I, II, and III bond release <br />on 6.37, 7.76, and 21.97 acres, respectively, at the Munger Canyon Mine. DRMS currently holds <br />a reclamation performance bond in the amount of $49,121.12 for the Munger Canyon Mine. The <br />current reclamation liability for the site is calculated at $44,468.10. Under SL -3, DRMS <br />proposes to release the entire $44,468.10 from reclamation liability, return the entire $49,121.12 <br />of bond held, and terminate jurisdiction over the site. DFB concurs with DRMS's Proposed <br />Decision and recommends Phase I / II / III bond release and TOJ at the Munger Canyon Mine. <br />Thank you and your staff for coordinating this bond release action through DFB.
