August 20, 2018

Stephanie Mitchell
Colorado Department of Natural Resources
Division of Reclamation, Mining and Safety
1313 Sherman Street, Room 215
Denver, CO 80203

RE: King Pit, File No. M-1987-012, 112 Amendment (AM02) Application Adequacy Review

Stephanie:

Please see the following responses to your adequacy review concerns of August 20, 2018
regarding the Division of Water Resources (DWR) comments dated August 15, 2018.

1. The King Pit does not anticipate exposing groundwater during any phase of mining.

2. Stormwater encountered and/or temporarily collected on site will either infiltrate into the
porous gravel of the site typical of the San Luis Valley or will evaporate within 72 hours.

3. Water will only be used on site as dust suppression. Any water required for dust
mitigation will be purchased and brought on site by a certified and independent Operator.

DWR had an additional comment regarding Exhibit G specifically, “Groundwater is unlikely to
be encountered during any phase of mining at the King Pit; however, a Substitute Water Supply
Plan (SWSP) is in place due to requirements dictated by Alamosa County.” However, careful
review by GLA Staff yields an in office error. Please revise the statement of Exhibit G to read:

“Groundwater is unlikely to be encountered during any phase of mining at the King Pit.
Because the alluvial gravel to be mined is dry, no water losses will occur from the gravel
resource during mining.”

Please do not hesitate to contact me with questions or concerns.

Regards,

Katie Todt
(314) 704-4505
Greg Lewicki and Associates
