BECKWITH <br />FONTANARI OBJECTIONS AND COMMENTS / SNOWCAP BOND APPLICATION SL -I I / PG. 7 <br />In October, 2016, the Eldridge Survey Plats, and the photographs of the depressions and <br />sinkholes were filed with DRMS in Application TR -69, as part of Fontanari's Response to <br />Repair Plan and Objections to Proposed Decision. On August 14, 2018, the DRMS inspection <br />team orally acknowledged to the Fontanari team members present, including the undersigned, <br />that they had received and reviewed these materials in advance of the 2018 inspections. <br />2. Observed surface subsidence features. <br />DRMS' bond release inspection was conducted August 14-16, 2018. During that <br />inspection, Mr. Wein, of DRMS, duly logged GPS coordinates and photographed all <br />conditions noted hereafter for the expressed purpose of creating a plat of the Study Area. Mr. <br />Wein's equipment, however, was not programmed to record elevation, thereby preventing <br />accurate documentation of surface depressions. To date, DRMS has not provided a copy of <br />Mr. Wein's plat to Fontanari. <br />On August 24, 2018, a Fontanari team again visited the inspection sites. As a result of <br />these inspections, the following subsidence features are known to exist: (The locations of <br />these Events are set forth in Fontanari Exhibit 10. <br />Subsidence Depression A / Tract No. 71 West <br />This subsidence depression straddles the western boundary of Tract No. 71 with the <br />eastern boundary of the Carey Tract. The subsidence is situated at the northern end of Carey <br />Pond, which generally "leaks like a sieve," allowing water to drain into the soil. Indeed, in <br />1992, 1993 and 1994, Powderhorn filed Annual Hydrology Reports with DRMS quantifying <br />"spiked" inflows of waters arising from surface irrigation involving water placed in the Carey <br />Pond. Fontanari Exhibit 11 (containing copies of (1992 AHR, Pgs. 6, Table M92-5; 1993 <br />AHR, Pg. 6, Table M93-1; 1994 AHR Pg. 5 Table M94-1) <br />The depression is quite observable. Its western rim contains several sinkholes. This <br />depression lies to the west of the location where, under TR -69, Snowcap has been authorized <br />to install concrete plugs to purportedly prevent hydrologic communication between surface <br />water and the abandoned air ventilation shaft shown in the 1980 GEX map. <br />This depression was photographed and documented in the 2016 Eldridge Survey Plat <br />together with the noted sinkholes. It was also documented, with GPS coordinates and <br />elevations, in the 2016 Updated Eldridge Survey Plat. Both the original and updated survey <br />plats (together with photographs of the staked and located sinkholes) were filed with DRMS <br />in October 2016, as part of the Fontanari Objection to Snowcap Repair Plan (TR -69). <br />(Fontanari Exhibit 12) <br />
