Beckwith, Esq., and Tanner J. Walls, Esq., of Messner Reeves <br />LLP in Denver, Colorado, represent Mr. Rudy Fontanari, Trustee of the Fontanari Family <br />Revocable Trust: owner of lands involved in the above -referenced application (Fontanari). <br />The public notice related to SL -11 authorized objections and comments to SL -11 within thirty <br />(30) days of the completion of the Bond Release Inspection on August 16, 2018. <br />Accordingly, Fontanari now timely objects to and comments upon SL -11. <br />The name, address and telephone of the Objecting and Commenting Party is: Mr. Rudy <br />Fontanari, Jr.; Trustee, Fontanari Family Revocable Trust; 3316 E 3/4 Rd.; Clifton, CO 81520; <br />970-434-7948. <br />I. FACTUAL BACKGROUND <br />A. Fontanari owns lands within the SL -11's proposed scope. <br />Fontanari owns Tracts Nos. 23, 35, 67, 70, 71, 77, 78, 79, and 102. These tracts lie in <br />Secs. 34 and 35, T10S R98W, 6th P.M. The parcels' boundaries are set forth in Fontanari <br />Exhibit 1. The Roadside Mine (a/k/a South Portal Mine) lies under portions of these parcels. <br />Fontanari lands involved in SL -11, referred to herein as the "Study Area," are shown in Tab 5 <br />of Snowcap Coal Company's SL -11 Application (Application). That area includes tracts 23, <br />35, 67, 70, 71, 77, 78, and 102. The Study Area lies north of Rapid Creek. (Fontanari <br />Exhibit 1) <br />
