OPERATORS <br /> SHOULD READ THE FOLLOWING PAGES CAREFULLY IN ORDER TO ASSURE COMPLIANCE <br /> WITH THE TERMS OF THE PERMIT AND APPLICABLE RULES AND REGULATIONS. If a <br /> Possible Violation is indicated, you will be notified under separate cover as to when the Mined Land <br /> Reclamation Board will consider possible enforcement action. <br /> INSPECTION TOPIC: Gen. Compliance With Mine Plan <br /> PROBLEM/POSSIBLE VIOLATION: Problem: Colorado Land Reclamation Act for the Extraction of Construction <br /> Materials 34-32.5--112(1)(VI) states that the operator must provide "information sufficient to describe or <br /> identify the type of mining operation proposed and how the operator intends to conduct such operation. The <br /> mining method at this site was changed by operator from dredge (wet) mining, as approved in the current <br /> mining plan, to dewatering and "dry" mining without Division approval of a modification to the approved mining <br /> plan. Failure to follow the approved mining plan could be found by the MLRB as a violation pursuant to 34-32.5- <br /> 124 for failure to comply with the conditions of and order, permit or regulation. <br /> CORRECTIVE ACTIONS: Immediately and permanently discontinue all dewatering and dry mining activity at the <br /> site, and conduct all operations according to the approved mining and reclamation plans, until such time as the <br /> Division approves any change to the current plans via the appropriate permitting action (permit revision or <br /> amendment). <br /> CORRECTIVE ACTION DUE DATE: 9/13/18 <br /> Page 1 of 4 <br />
