CERTIFIED MAIL <br /> RETURN RECEIPT NO. 7016 0750 0000 7384 4257 <br /> September 10, 2018 <br /> AGGREGATE <br /> Mr. Jared Ebert INDUSTRIES <br /> Division of Reclamation Mining and Safety <br /> 1313 Sherman Street, Room 215 <br /> Denver, CO 80203 <br /> Re: Permit Number M-1994-093 —Dahlia North Resources - Request for Full Release <br /> Dear Jared: <br /> On January 30, 2006, the Division released the 101.34 acre water storage reservoir from <br /> Permit M-1994-093, reducing the permit acreage to 89.16 acres. Land surrounding the <br /> reservoir was not released at that time as revegetated areas had not established <br /> sufficiently and backfilling of the Area 2C 34 acre parcel east of Bull Seep had not been <br /> completed. All reclamation activity has since been completed and Aggregate Industries <br /> (AI) is requesting a full and final release of the remaining 89.16 acres of Permit M-1994- <br /> 093. <br /> The Area 2C 34 acre parcel was backfilled and stabilized for future urban development in <br /> accordance with the approved reclamation plan. The land was subsequently developed <br /> for industrial use and is owned by New Dux LLC and Dux Limited Partnership, whose <br /> address is provided on the enclosed Division release request form. <br /> In accordance with Division requirements following an inspection conducted June 2, <br /> 2015, Al conducted additional weed control around the reservoir. As noted in AI's <br /> corrective action responses to the Division regarding weed control, City of Thornton <br /> owns the reservoir and surrounding land and had assumed land maintenance activities <br /> following its purchase of the reservoir from Al. Thornton's maintenance activities were <br /> limited to mechanical means in accordance with its Public Works requirements relative to <br /> water storage reservoirs. <br /> Al resumed additional weed maintenance activity following the 2015 inspection in <br /> accordance with TR-04, approved by the Division September 16, 2015. AI's weed <br /> control activities included mowing the site once in the fall and once in the summer <br /> starting Fall of 2015 and continuing through Summer of 2017. Thornton began to allow <br /> some chemical control in areas farther from the reservoir edges and chemical control was <br /> used in place of mowing in Fall 2017.
