removal. The inadequacy of the financial warranty due to the storage of refuse and <br />junk vehicles on the site was identified as a compliance issue in the inspection <br />report. <br />3. The Division also identified an inadequate mine identification sign as <br />another compliance issue in its inspection. The mine identification sign posted at <br />the entrance to the site was dilapidated and the required information was not <br />legible. <br />4. The Division gave Operator until August 18, 2017 to remedy the <br />possible violations and corrective actions identified in the June 19, 2017 inspection <br />report. <br />5. The Division also sent Operator a Notice of Surety Increase on June <br />19, 2017, informing Operator that the cost to reclaim the site was estimated to now <br />be $24,485, an increase of $12,911 over the bond held by the Division. The Division <br />informed Operator that the increase in financial warranty was due by August 18, <br />2017. <br />6. On August 21, 2017, the Division received a written request from <br />Operator for an extension of the deadline to submit the increase in financial <br />warranty to October 18, 2017. <br />7. Operator did not comply with the corrective actions by the August 18, <br />2017 deadline or the October 18, 2017 extension she requested. <br />8. On March 14, 2018 the Division conducted another inspection of the <br />site. The inspection report, signed March 20, 2018, identified the same three <br />possible violations and corrective actions as the June 19, 2017 inspection report and <br />provided a corrective action due date of May 21, 2018. <br />9. On March 20, 2018, the Division sent Operator another Notice of <br />Surety Increase informing her that a new financial warranty amount of $21,840 had <br />been calculated as necessary to reclaim the site in its state. The new amount <br />represented an increase of $10,266 over the bond held by the Division. The increase <br />in financial warranty was due to the Division by May 20, 2018. <br />10. Operator failed to submit the increase in financial warranty or correct <br />any of the issues identified in the March 20, 2018 inspection report by the deadlines <br />identified in the March 20, 2018 Notice of Surety Increase or inspection report or at <br />any time thereafter. <br />Deb R.udibaugh <br />M-1995-057 <br />MV -2018-013 <br />X <br />
